Clashes in Kanaky: USTKE calls one-day general strike
RNZI has reported that the Union of Kanaky and Exploited Workers (USTKE)
in Kanaky/New Caledonia will hold a one-day general strike tomorrow as 22
of its members are due in court appealing jail sentences for their role in
the clashes with police in Noumea in January. [ USTKE ]
The USTKE is committed to struggling against capitalism and colonialism in
the south Pacific and is amongst the most militant of unions in the
Pacific. It combines industrial and political action in an island that is
still a colony of France and for decades indigenous people and workers
have struggled for self-determination.

Gardens offer us a perfect opportunity to reconnect to our true selves and

gardening, from planting seeds to harvesting food, as a way of deepening
our conscious relationship with the creative force of the universe. If we
are willing to shift our intention from dominating, or at least directing
nature, to co-creating with nature instead, we may discover a deep peace
and renewed sense of wonder.
To co-create we must first begin with a foundation of mutual respect. As
you create your garden in partnership with nature, you can respect the
earth, water, insects and animals by using organic seeds, soil and
fertilizers. You can also communicate with the plants, insects and
elements involved in your garden, and create a regular practice of
stillness to listen for any messages they may have for you. When it comes
time for harvesting fresh vegetables or picking beautiful blooms, you
might even ask permission first.. If you ask with an open heart, you will
always receive an answer.
Imagine what it would be like to surrender certain aspects of your human
world to the precision and surety of the natural environment. You might
decide, for example, to forego your calendar and plant in rhythm with the
cycles of the moon. Or, you might choose to ignore clock time and water
your garden when the sun hits a certain position in the sky. By opening
your garden experience to more of nature's input, you can become available
to witness a whole universe of miracles, while engendering a greater sense
of honor between the two worlds.
When we recognize ourselves as allies, co-creators, with the earth and the
natural world, our relationship to our environment begins to change. We no
longer feel the need to control the circumstances around us and can relish
in the perfection of all that is.

WASHINGTON - Larry Matlack, President of the American Agriculture
Movement (AAM), has raised concerns over the issue of U.S. grain
reserves after it was announced that the sale of 18.37 million
bushels of wheat from USDA's Commodity Credit Corporation (CCC) Bill
Emerson Humanitarian Trust.
"According to the May 1, 2008 CCC inventory report there are only
24.1 million bushels of wheat in inventory, so after this sale there
will be only 2.7 million bushels of wheat left the entire CCC
inventory," warned Matlack. "Our concern is not that we are using the
remainder of our strategic grain reserves for humanitarian relief.
AAM fully supports the action and all humanitarian food relief. Our
concern is that the U.S. has nothing else in our emergency food
pantry. There is no cheese, no butter, no dry milk powder, no grains
or anything else left in reserve.
The only thing left in the entire CCC inventory will be 2.7 million
bushels of wheat
which is about enough wheat to make 1⁄2 of a loaf of bread for each
of the 300 million people in America."
The CCC is a federal government-owned and operated entity that was
created to stabilize, support, and protect farm income and prices.
CCC is also supposed to maintain balanced and adequate supplies of
agricultural commodities and aids in their orderly distribution.
"This lack of emergency preparedness is the fault of the 1996 farm
bill which eliminated the government's grain reserves as well as the
Farmer Owned Reserve (FOR)," explained Matlack. "We had hoped to
reinstate the FOR and a Strategic Energy Grain Reserve in the new
farm bill, but the politics of food defeated our efforts. As farmers
it is our calling and purpose in life to feed our families, our
communities, our nation and a good part of the world, but we need
better planning and coordination if we are to meet that purpose. AAM
pledges to continue our work for better farm policy which includes an
FOR and a Strategic Energy Grain Reserve."
AAM's support for the FOR program, which allows the grain to be
stored o°©n farms, is a key component to a safe grain reserve in that
the supplies will be decentralized in the event of some unforeseen
calamity which might befall the large grain storage terminals.
A Strategic Energy Grain Reserve is as crucial for the nation's
domestic energy needs as the Strategic Petroleum Reserve. AAM also
supports full funding for the replenishment and expansion of Bill
Emerson Humanitarian Trust.

New law codifies loss of American civil rights
THE ISSUE
President Bush has signed a law that broadly expands the government's
spying powers.
PRESIDENT Bush had good reason to indulgently praise Congress for passage
of wiretap legislation that surrenders citizens' rights to be free of
unreasonable search and seizure, and releases telecommunications companies
from liability for participating in the administration's once-secret
spying program.
The new law eliminates any chance of holding the Bush administration
accountable for its unlawful actions. It also expands the government's
spying powers for reasons other than terrorism. It weakens constitutional
safeguards with a loophole that permits wiretaps on Americans without a
court order, just with the government's say-so.
By granting telcoms immunity retroactively and in the future, the Foreign
Intelligence Surveillance Act nullifies nearly 40 lawsuits that could
have led to examinations of the administration's unauthorized program.
A federal lawsuit challenging the constitutionality of the law, filed
just hours after Bush's Rose Garden signing of the measure, could be a
way to rein in the government's expanded network.
The Senate approved the bill that gives the executive branch power to
require companies like AT&T, Verizon and Google to turn over text
message, e-mail and phone call data without specific court orders when
one party is believed to be overseas. Though Missouri Republican Sen.
Christopher Bond says no one needs to worry "unless you have al-Qaida on
your speed dial," the blanket powers could intrude on innocent
communications without allowing for protest or remedy.
The administration has never fully explained why it can't maintain
constitutional guarantees while spying. Moreover, the few members of
Congress who have received intelligence briefings on the program say the
new law is a mistake, an eradication of due process.

Don't be fooled by the misleading slogans. Big money
desperately wants to gut our constitution - and they can do
it if we open the door to them with a Constitutional
Convention (ConCon).
Water: A&B, Wailuku Water, ML&P and EMI all want you to
believe that "Equal Access to Water" is a good thing. Sounds
good, doesn't it? But the Hawai'i constitution already says
that the people (that's you and me) own the water and lays
out the use priorities. What so-called "equal access" will
do is give the water to the big landowners and take it away
from the people.
You think we have a hard time getting water now? At least
now, we can go to court and get our water back. Once the
Constitutionally guaranteed water hierarchy is gutted, we
won't have a leg to stand on. Good-bye public water, hello
big-land-owner water-gouging.
Shoreline Access: Think Hawaiian rights and entitlements are
just for Hawaiians? Think again. Your right to visit
beaches in front of hotels depends on the Constitutionally
guaranteed Hawaiian rights. Without Hawaiian rights, the
hotels and shoreline estates can close off access to the
beaches like they do on the mainland.
Good Paying Jobs: Here's another deceptive slogan: "Right to
Work". What that really means is right to be exploited,
right to become a low-paid worker and right to lose your
benefits because Right to Work is
Union-busting. Multinational corporations want to get this
so-called right to work language into the constitution so
they can eliminate union jobs. Don't fall for their
exploitive and deceptive words.
Privacy Rights: Our existing constitution has some of the
strongest language favoring privacy rights of any state.
Nuclear Plants: The same corporations who own most of the TV
and radio stations, GE and Westinghouse, are pushing to build
new nuclear plants. Our constitution (for very good reasons)
prohibits nuclear plants and allowing disposal of radioactive
material. In fact, there is a hair brained idea floating
around to site a nuke on Kaho'olawe. (Fortunately, not being
proposed by any utility.) One spill and the beaches of Maui,
Hawai'i, Moloka'i and Lana'i are contaminated.
Hospitals: Progress on getting acute care hospitals for Kihei
and Lahaina is slow. We have two groups. One group wants
private hospitals and the other wants a plan whereby Kihei
and Lahaina get acute care hospitals which are tied into Maui
Memorial and are public hospitals available to all.
But those who want the private hospital are impatient with
the Certificate of Need which provides an island-wide
planning process for hospitals. There is no doubt Lahaina
needs an acute care facility ASAP. But using the sledge
hammer of rewriting our constitution is not a safe way to
accomplish this.
Whether you support the private hospital or the idea of
satellite hospitals, rewriting the constitution is not
necessary to accomplish either goal. Those who (deservedly)
want better care at MM and acute care in Lahaina are being
used by the far right in an agenda that goes well beyond
hospitals.
Delegates: Pro-ConCon forces tout this a "Democracy in
Action" and talk about the "people" rewriting the
constitution. But think about it. Do you have the time and
money to take off work for days or weeks, go to 'Oahu and
rewrite the constitution?
Who can take the time and not lose their job or income?
Lobbyists and Corporate representatives, that's who! Do you
trust them to rewrite our constitution for our benefit?

With sugar cane and pineapples fading, Hawaii's next big export to the
U.S. mainland could be less sweet - 100,000 tons of trash a year.
In one of the most ambitious municipal disposal plans yet, Oahu, Hawaii's
most populous island, is looking to send some of its garbage on a
2,600-mile voyage to the West Coast.
With 900,000 residents and close to five times as many tourists each
year, Oahu is running out of landfill space. And neighbors on other
Hawaiian islands say they have enough garbage of their own, thank you
very much.
Some Oahu residents see the export of trash as running counter to the
benevolent "aloha spirit." They point out that Hawaii restricts
agricultural goods coming in or going out, with rigorous airport
inspections, but now wants to put mountains of garbage on oceangoing
barges.
"That's certainly not the type of aloha we need to send to the mainland,"
said Jeff Mikulina, Sierra Club-Hawaii director. "It's our responsibility
to take care of that here at home."
Several mainland municipalities, from New York City to Anchorage, Alaska,
have been exporting trash for years, and the practice is on the rise.
For all its natural beauty - spectacular mountains, volcanic-sand
beaches, and a delightful floral scent that rides on the gentle sea
breezes - Oahu produces an awful lot of garbage: 10 pounds per resident a
day, compared with a national average of 4.5, according to Russell Nanod
of Waste Management, the company that operates the sole municipal
landfill.
This may be because of the millions of tourists visiting each year, or
because nearly everything from fresh vegetables to construction materials
has to be shipped to the islands, requiring a lot of packaging that
ultimately ends up in the trash.
The most urban of the seven populated Hawaiian Islands, Oahu has dozens
of high-rises, the military base at Pearl Harbor and Hawaii's biggest
city, Honolulu. It generates nearly 1.8 million tons of trash per year,
and about 500,000 tons of that is buried in the municipal landfill. At
that rate, the 200-acre landfill will be at capacity within 15 years.
The Honolulu City Council, which governs all of Oahu, wants to hire a
company to haul some of it away. One bidder is proposing to take the
trash across the Pacific, sail it up the Columbia River and deliver to
the biggest landfill in Washington state.
The planned 100,000 tons a year is only about 6 percent of the island's
trash.
"It's a Band-Aid on a bullet hole," said John Guinan of the Trash Man
Hawaii, a garbage hauling company. "But we don't really have much of an
alternative at this point." At the same time, he warned: "I guess it's a
good idea until the barge tips over and we'll have a massive spill in the
South Pacific."
Honolulu officials say that if the barge were to sink, it would pose
little danger to the environment because the garbage would be compacted,
baled and wrapped in four airtight layers of plastic.
Joe Casalini, business development director for the Roosevelt Regional
Landfill, which would receive Hawaii's trash under one of the proposals,
said Washington state's sparsely populated and relatively arid Klickitat
County has welcomed the dump, which is the major business in the area. It
converts methane from its waste into electricity.
Honolulu City Councilman Gary Okino said that while it takes about seven
years to open a new landfill, Oahu officials have put off selecting a
location. Landfills are limited to parts of the island that are not over
an aquifer and have low rainfall.
"You need a big hole in the ground," he said. "Then, if it's near a
residential area, you'll have a huge uproar."
By shipping some of Oahu's garbage to the mainland, the city would buy
time to expand a curbside recycling program and build a third boiler at
its H-Power plant, which turns municipal garbage into electricity.
The new boiler would extend the landfill's life to 30 years because it
would be large enough to burn all of Oahu's municipal waste, leaving
mainly ash and residue to be dumped in the landfill.
Hawaiian Waste Systems of Seattle was by far the lowest bidder of three
companies that want to ship the trash. The company bid $99 per ton, which
would cost the city $9.9 million a year, plus $7.8 million in lost
landfill dump fees.
The city had planned to announce the winner of the contract this month,
but that was put off after two rivals that bid $184 and $204 protested,
accusing Hawaiian Waste Systems of coming in with an impossibly low bid -
an allegation the company denies.
The city said it cannot move forward until the protests are resolved.

Zimbabwe: Profits before principles
THE people of Zimbabwe have to change the situation for themselves
without interference from those who in the past have been guilty of
as many abuses of human rights as Robert Mugabe.
Perhaps thatâ^À^Ùs why the leaders of the African nations who
gathered in Egypt this week have refused to condemn him.
The people of Africa have long memories and they know that those
governments shouting the loudest about human rights abuse and lack
of democracy in Zimbabwe come from a long line of imperial
war-mongers and barbarians.
Many of the conflicts raging in todayâ^À^Ùs world have their roots
in British colonial history. Zimbabwe is no exception. While the
British Government and the media rant and rave about â^À^Øthe
evilsâ^À^Ù of Robert Mugabeâ^À^Ùs regime in Zimbabwe, they would do
well to remember that it hasnâ^À^Ùt prevented individual British
politicians and multinationals profiting from this evil.
Itâ^À^Ùs a bit rich for Gordon Brown to call for sanctions against
a man who is a product of a system created by the former white
elite rulers who havenâ^À^Ùt really gone away. The British-owned
Anglo-American Company, which has mining interests in Zimbabwe for
the past 60 years, post-independence, has stated that while it is
concerned about the present situation it has no intention of giving
up its project â^À^Ó or should that be profit?
A raft of other companies â^À^Ó including Shell, BP, Barclays Bank
and Tescoâ^À^Ùs -â^À^Ó while describing the situation as deplorable
are hanging in there â^À^Øas part of their duty to the workforce
and the local communityâ^À^Ù. Who believes that?
Tory Shadow Business Minister Jonathan Djanogly owns at least
£300,000 worth of shares in many of the above companies described
by some Labour politicians as â^À^Üblood money in which greed
supersedes moral responsibilityâ^À^Ý.
In response to worldwide criticism, the British have divested
Mugabe of the honorary knighthood awarded him in 1994 by then
British Prime Minister John Major, who last week was awarded the
freedom of the City of Cork.
The British have used its caste system of accolades, knighthoods
and awards to test those whom they perceived as posing a threat to
its interests in whatever corner of the universe. Mugabe forfeited
any credibility as a revolutionary leader when he accepted this
dubious honour. He was not â^À^Ødubbedâ^À^Ù an honorary knight of
some antiquated English order because he fought to free Zimbabwe
from British rule. That dubious â^À^Øhonourâ^À^Ù was in reward for
services rendered to British business interests, many of whom now
sit on the Tory front benches.
Zimbabwe under Mugabe rule is no different from Zimbabwe under Ian
Smith; only the colour has changed. The neo-colonial mindset, like
those who hoisted the Union Jack over the City Hall in Cork, is
still the same.
The Brown Government declared last week it is prepared to name and
shame members of the junta keeping Robert Mugabe in power. They
could start with the entire British establishment for, as the
people of Zimbabwe starve, its produce is exported to fill the
supermarket shelves of the British retail giants, in the same way
that the produce of Ireland was exported to England in the years of
An Gorta Mór. (the Irish famine)

I get it. People are pissed at Ralph Nader. They blame him for "stealing"
votes from Gore and consequentially Bush defeating Gore in the 2000
election. They hate Ralph, and his droopy little eye, even though Pat
Buchanan also "stole" some votes from Bush in Florida (and Iowa, New
Mexico, Oregon, and Wisconsin) and no one blames him for having the nerve
to participate in our democracy.
Asking people to vote for Ralph Nader is sort of like asking them to
perform self-flagellation. They want to bet on a horse that's going to
win, and I have yet to form a compelling argument for how the good guys
can win. So I've accepted that I'll just have to pay tribute to Nader,
the great humanitarian and environmentalist, in some sort of last-ditch,
meaningless gesture. I'll just request my headstone read: I didn't like
any of you, respected few of you, and should have voted for Ralph
Nader.... Or something ...
After Obama voted for telecom immunity, my inbox exploded with angry
diatribes from my Progressives readers, all of who demanded explanations
for the Senator's suspicious behavior. First, I explained that I have no
access to Obama's thinking. Second, I explained that, while Obama has
said some promising things in the past (something about having gay
friends in red states,) he never claimed to be THE Progressive candidate.
We assigned all our hopes and dreams to a man who seemed Progressive when
contrasted against the fiery train wreck sitting in our White House. We
all sort of hoped things would work themselves out.
They didn't. Obama has catered to the middle with gun control, telecom
immunity, the death penalty, faith-based initiatives, and troop
withdrawal landmarks. The only man who can save us now is Ralph Nader.
Before you click that little, red "X" in the corner of your browser, let
me explain myself. The Progressives should petition that Ralph Nader be
allowed access to national, televised debates in a three-way discussion
with John McCain and Barack Obama.
Having Ralph Nader participate in a debate is not only the democratically
right thing to do, but it will force Obama to think more progressively in
his policies. It's easy to look like a liberal standing next to John "I'm
Crazy And Will Bring On The Apocalypse" McCain. All you really have to do
is stand up straight, say something about Universal Healthcare, and not
become giddy over Iranians developing lung cancer. Even if Obama
backpedals on promises, like holding telecom companies accountable for
spying on Americans, he STILL looks liberal standing next to McCain.
But if Nader is there, scowling at Obama's sweat-soaked profile, suddenly
Americans will see their full spectrum of political choices. Obama and
Nader don't get along. At all. Apparently, Obama's charm and pretty smile
didn't woo battered hardass Nader, who I imagine nearly took off Obama's
head the second Obama said something about wanting to compromise on
certain Progressive issues. I guess it's hard to smooth-talk a man who
was once tailed by a General Motors-hired private spy. If he could
withstand attacks from one of the most powerful corporations in the
world, Nader could handle Obama's charm. Obama seemed shocked that Nader
didn't lap up his pretty promises like a trained dog.
"My sense is that Mr. Nader is somebody who if you're -- don't listen and
adopt all of his policies, thinks you're not substantive. He seems to
have a pretty high opinion of his own work," Obama remarked after meeting
with Nader. I'm not sure what that means. Is it the fact that Nader is
principled or the fact that he's proud and protective of his decades of
work in consumer safety that bothers Obama the most?
Nader's presence would be a welcome change in this election. Millions of
voters feel unrepresented by the Democratic and Republican parties. These
people would find refuge in voting for Independent candidates. They just
don't know it yet because they don't know they have choices. Every four
years, they think they must vote for Tweedledee or Tweedledum, which is
understandable considering networks refuse to even televise other
candidates.
Early this year, Dennis Kucinich was shut out of a televised MSNBC
debate, despite the fact that the network originally invited him to
participate and America still claims to be a "free society," one with
open, fair elections. The debate quickly became homogenized once Kucinich
disappeared. Edwards said something...probably about his father working
in a mill. Then Edwards fell out and Hillary and Obama became one,
indistinguishable blob I call Hillbama as they bickered for months over
the trivial differences between their campaigns. Hillary cried. Barack
called a reporter "sweetie." Tim Russert died from the strain of it all.
The end.
Now, we arrive at another critical juncture in the race toward the White
House. Yet again, we find ourselves at the mercy of huge network
conglomerates that decide what ideologies the American people will hear.
Interestingly, six percent of people polled in a CNN/Opinion Research
Corporation survey said they are likely to vote for an alternative
candidate. Who is going to represent their voices?
Anyone who shows a reasonable measure of competitiveness should be
permitted to debate. And Ralph Nader is definitely competitive. Surely,
no one who blames Nader for Gore's defeat in 2000 could argue
differently. One can either admit Nader is incredibly influential and
cajoled many Democrats to vote for him, or they can argue he's totally
insignificant and had no influence in the 2000 election. If they agree
that he was influential in 2000, then they must recognize that he's
influential enough to participate in the debates.
Or we can be adults and stop casting blame for Gore's mishandled 2000
campaign. We can act like a civilized country and recognize that millions
of voters are undecided, unrepresented, and would love to hear what Mr.
Nader has to say. One needn't vote for Nader in order to recognize that
he has the right to run for president, and as part of that right, he must
be heard in debates.
At the moment, Nader needs to bump that 6% up to 10% in order to
participate in national debates. Oh, he also needs to jump through
thousands of hoops and cut through forests of red tape, and even then,
all MSNBC needs to do is say "no," like they did to Dennis Kucinich, in
order to silence Nader forever.
If Nader isn't permitted to debate, not only will our democracy suffer,
but Obama supporters will suffer as well. Nader's presence will force the
dialogue to expand past pointless bickering over lapel pins and ex-wives.
Maybe his presence would even force us to examine the big issues
differently. Maybe, for once, our nation will discuss issues of peace
rather than how long the current war should last. Maybe we'll start to
seriously discuss the environment, poverty, human rights...the
possibilities are endless.
Only when a man like Ralph Nader can participate in our democracy can we
call ourselves -- and our time -- Progressive.

High gas prices have prompted communities across the country and at least
one state to experiment with four-day workweeks for public employees.
Hawaii is considering the concept.
Gov. Linda Lingle has said state agencies are examining the possibility
of cutting a day from the regular five-day workweek for some government
employees, but no switch is imminent.
"It's something we're looking at very seriously," Lingle said last week.
"The bottom line for us is, Can we maintain the same level of public
services by going to a four-day workweek? If we can't, then we likely
would not make that switch."
Lingle said discussions have been ongoing among the Department of Human
Resources Development; the Department of Business, Economic Development
and Tourism; union officials; and others.
The concept of a four-day workweek is being attempted in communities
across the country as local governments search for ways to help residents
deal with the ever-increasing cost of gasoline.
Expanding work shifts to 10 hours and eliminating work on Fridays is seen
as a way to get cars off the road and save commuters a day of sitting in
traffic. The move also is expected to reduce costs for government by
cutting electric bills and costs for fueling state vehicle fleets.
Utah is believed to be the first government to enact the shift on a
statewide level.
Beginning next month, that state will launch a yearlong experiment that
will give about 17,000 out of 24,000 executive-branch employees a shorter
workweek. The order issued by Republican Gov. Jon Huntsman will not cover
state police officers, prison guards or employees of the courts or Utah's
public universities.
State government is the largest employer in Hawaii.
Any change in the workweek for Hawaii employees would require approval by
public employee unions.
"This would be something to do with their hours and their conditions of
employment," said Randy Perreira, executive director of the Hawaii
Government Employees Association.
With negotiations set to begin on a new contract for the 40,000-member
union, Perreira said the union has submitted proposals to shift more
workers to a shorter workweek.
He noted that some state offices have the flexibility to implement
four-day weeks for employees, but whether the union would support a
statewide shift depends on the proposal.
"The devil's always in the details," Perreira said. "It's something we'd
have to take a look at."
Essential services, such as prisons and health care offices, would
continue daily operations.
But Lingle also noted that cutting a day of some services might not have
a dramatic impact, because many government services are available online.
"We want to make certain that we consider everybody's opinion, because it
would be a dramatic change," she said.
More energy-saving and cost-cutting measures are likely to be explored in
the Legislature next year. House Democrats say staff members are studying
strategies such as staggered working hours and incentives for allowing
workers to telecommute.

Unconscious Communication Chronic Lateness
Being late for an appointment or a date can seem like a small thing that
really doesn't matter, but it communicates volumes, whether we mean it to
or not. Being kept waiting is an experience that almost no one enjoys,
because at best, it wastes their time, and at worst, it indicates a lack
of regard. It's as if we're saying that our time is more important than
their time, so we don't need to honor them by showing up when we said we
would. When we are running late, it means a lot if we call and let the
person know, especially if it's going to be more than ten minutes.
However, if we are chronically late, it may take more than a phone call to
properly address the issue.
If it's become a habit of ours not to be on time, we may want to look
inside ourselves and see what's going on. It's easy enough to make excuses
about our behavior, or to project responsibility on the other person,
perceiving them to be uptight if they are irritated by our tardiness.
What's more difficult, and more meaningful, is looking at ourselves and
asking why it is that we always, or often, show up late. Sometimes this
happens out of a lack of self-regard, as if we aren't really important
anyway, so why will anyone care if we're late, or don't show up at all.
Chronic lateness can also stem from being disorganized, or simply trying
to do too much in one day. Another possible reason for being late to a
particular appointment, or date, is that we don't really want to be there.
We communicate our disinterest or boredom by not showing up on time.
Whatever our reasons, if we raise them to the conscious level, we have an
opportunity to live a more conscious life. As we begin to understand the
deeper reasons behind our inability to show up on time, we have the option
to communicate clearly and consciously about how we really feel, rather
than communicating unconsciously by being late.

Below is a courageous and honest article by Ha^Òaretz correspondent Gideon
Levy, entitled ^ÓWorse than Apartheid.^Ô It was published recently in
Ha^Òaretz, and it tells of the reactions and opinions expressed by a
prestigious group of leaders from South Africa upon their tour through the
West Bank. It was sent to me by my friend John Whitbeck. Whitbeck is an
international lawyer based in Jedda, Saudia Arabia. Whitbeck has been an
advisor to the Palestinian negotiating team in negotiations with Israel,
as well as an adviser to various Fatah committees that negotiate on a
proposed solution to the Israeli-Palestinian conflict. Since 1988 his
articles on behalf of Middle East peace have been published more than 450
times in more than 70 Arab, Israeli, and international newspapers,
magazines, journals and books.
In his introduction to Levy^Òs article, Whitbeck wrote:
Having travelled extensively in South Africa (including the "independent
states" of Bophuthatswana, Ciskei, Transkei and Venda) between 1969 and
1985, when that country's apartheid regime was in full flower, as well as
in Israel/Palestine more recently, it has always seemed to me that
comparisons of Israeli treatment of Palestinians to the South African
apartheid regime's treatment of its natives are grossly unfair ... to
white South Africans.
The sophisticated South African visitors cited by Levy in this article, as
well as Nelson Mandela, Desmond Tutu and Ronnie Kasrils (a Jewish minister
in the current South African government), all clearly agree. Indeed, it is
inconceivable that anyone personally familiar with both systems could
disagree.

I thought they would feel right at home in the alleys of Balata refugee
camp, the Casbah and the Hawara checkpoint. But they said there is no
comparison: for them the Israeli occupation regime is worse than anything
they knew under apartheid. This week, 21 human rights activists from South
Africa visited Israel. Among them were members of Nelson Mandela's African
National Congress; at least one of them took part in the armed struggle
and at least two were jailed. There were two South African Supreme Court
judges, a former deputy minister, members of Parliament, attorneys,
writers and journalists. Blacks and whites, about half of them Jews who
today are in conflict with attitudes of the conservative Jewish community
in their country. Some of them have been here before; for others it was
their first visit.
For five days they paid an unconventional visit to Israel - without
Sderot, the IDF and the Foreign Ministry (but with Yad Vashem, the
Holocaust Memorial and a meeting with Supreme Court President Justice
Dorit Beinisch). They spent most of their time in the occupied areas,
where hardly any official guests go - places that are also shunned by most
Israelis.
On Monday they visited Nablus, the most imprisoned city in the West Bank.
From Hawara to the Casbah, from the Casbah to Balata, from Joseph's Tomb
to the monastery of Jacob's Well. They traveled from Jerusalem to Nablus
via Highway 60, observing the imprisoned villages that have no access to
the main road, and seeing the "roads for the natives," which pass under
the main road. They saw and said nothing. There were no separate roads
under apartheid. They went through the Hawara checkpoint mutely: they
never had such barriers.
Jody Kollapen, who was head of Lawyers for Human Rights in the apartheid
regime, watches silently. He sees the "carousel" into which masses of
people are jammed on their way to work, visit family or go to the
hospital. Israeli peace activist Neta Golan, who lived for several years
in the besieged city, explains that only 1 percent of the inhabitants are
allowed to leave the city by car, and they are suspected of being
collaborators with Israel. Nozizwe Madlala-Routledge, a former deputy
minister of defense and of health and a current member of Parliament, a
revered figure in her country, notices a sick person being taken through
on a stretcher and is shocked. "To deprive people of humane medical care?
You know, people die because of that," she says in a muted voice.
The tour guides - Palestinian activists - explain that Nablus is closed
off by six checkpoints. Until 2005, one of them was open. "The checkpoints
are supposedly for security purposes, but anyone who wants to perpetrate
an attack can pay NIS 10 for a taxi and travel by bypass roads, or walk
through the hills.
The real purpose is to make life hard for the inhabitants. The civilian
population suffers," says Said Abu Hijla, a lecturer at Al-Najah
University in the city.
In the bus I get acquainted with my two neighbors: Andrew Feinstein, a son
of Holocaust survivors who is married to a Muslim woman from Bangladesh
and served six years as an MP for the ANC; and Nathan Gefen, who has a
male Muslim partner and was a member of the right-wing Betar movement in
his youth. Gefen is active on the Committee against AIDS in his
AIDS-ravaged country.
"Look left and right," the guide says through a loudspeaker, "on the top
of every hill, on Gerizim and Ebal, is an Israeli army outpost that is
watching us." Here are bullet holes in the wall of a school, there is
Joseph's Tomb, guarded by a group of armed Palestinian policemen. Here
there was a checkpoint, and this is where a woman passerby was shot to
death two years ago. The government building that used to be here was
bombed and destroyed by F-16 warplanes. A thousand residents of Nablus
were killed in the second intifada, 90 of them in Operation Defensive
Shield - more than in Jenin. Two weeks ago, on the day the Gaza Strip
truce came into effect, Israel carried out its last two assassinations
here for the time being. Last night the soldiers entered again and
arrested people.
It has been a long time since tourists visited here. There is something
new: the numberless memorial posters that were pasted to the walls to
commemorate the fallen have been replaced by marble monuments and metal
plaques in every corner of the Casbah.
"Don't throw paper into the toilet bowl, because we have a water
shortage," the guests are told in the offices of the Casbah Popular
Committee, located high in a spectacular old stone building. The former
deputy minister takes a seat at the head of the table. Behind her are
portraits of Yasser Arafat, Abu Jihad and Marwan Barghouti - the jailed
Tanzim leader. Representatives of the Casbah residents describe the
ordeals they face. Ninety percent of the children in the ancient
neighborhood suffer from anemia and malnutrition, the economic situation
is dire, the nightly incursions are continuing, and some of the
inhabitants are not allowed to leave the city at all. We go out for a tour
on the trail of devastation wrought by the IDF over the years.
Edwin Cameron, a judge on the Supreme Court of Appeal, tells his hosts:
"We came here lacking in knowledge and are thirsty to know. We are shocked
by what we have seen until now. It is very clear to us that the situation
here is intolerable." A poster pasted on an outside wall has a photograph
of a man who spent 34 years in an Israeli prison. Mandela was incarcerated
seven years less than that. One of the Jewish members of the delegation is
prepared to say, though not for attribution, that the comparison with
apartheid is very relevant and that the Israelis are even more efficient
in implementing the separation-of-races regime than the South Africans
were. If he were to say this publicly, he would be attacked by the members
of the Jewish community, he says.
Under a fig tree in the center of the Casbah one of the Palestinian
activists explains: "The Israeli soldiers are cowards. That is why they
created routes of movement with bulldozers. In doing so they killed three
generations of one family, the Shubi family, with the bulldozers." Here is
the stone monument to the family - grandfather, two aunts, mother and two
children. The words "We will never forget, we will never forgive" are
engraved on the stone.
No less beautiful than the famed Paris cemetery of Pere-Lachaise, the
central cemetery of Nablus rests in the shadow of a large grove of pine
trees. Among the hundreds of headstones, those of the intifada victims
stand out. Here is the fresh grave of a boy who was killed a few weeks ago
at the Hawara checkpoint. The South Africans walk quietly between the
graves, pausing at the grave of the mother of our guide, Abu Hijla. She
was shot 15 times. "We promise you we will not surrender," her children
wrote on the headstone of the woman who was known as "mother of the poor."
Lunch is in a hotel in the city, and Madlala-Routledge speaks. "It is hard
for me to describe what I am feeling. What I see here is worse than what
we experienced. But I am encouraged to find that there are courageous
people here. We want to support you in your struggle, by every possible
means. There are quite a few Jews in our delegation, and we are very proud
that they are the ones who brought us here. They are demonstrating their
commitment to support you. In our country we were able to unite all the
forces behind one struggle, and there were courageous whites, including
Jews, who joined the struggle. I hope we will see more Israeli Jews
joining your struggle."
She was deputy defense minister from 1999 to 2004; in 1987 she served time
in prison. Later, I asked her in what ways the situation here is worse
than apartheid. "The absolute control of people's lives, the lack of
freedom of movement, the army presence everywhere, the total separation
and the extensive destruction we saw."
Madlala-Routledge thinks that the struggle against the occupation is not
succeeding here because of U.S. support for Israel - not the case with
apartheid, which international sanctions helped destroy. Here, the racist
ideology is also reinforced by religion, which was not the case in South
Africa. "Talk about the 'promised land' and the 'chosen people' adds a
religious dimension to racism which we did not have."
Equally harsh are the remarks of the editor-in-chief of the Sunday Times
of South Africa, Mondli Makhanya, 38. "When you observe from afar, you
know that things are bad, but you do not know how bad. Nothing can prepare
you for the evil we have seen here. In a certain sense, it is worse,
worse, worse than everything we endured. The level of the apartheid, the
racism and the brutality are worse than the worst period of apartheid.
"The apartheid regime viewed the blacks as inferior; I do not think the
Israelis see the Palestinians as human beings at all. How can a human
brain engineer this total separation, the separate roads, the checkpoints?
What we went through was terrible, terrible, terrible - and yet there is
no comparison. Here it is more terrible. We also knew that it would end
one day; here there is no end in sight. The end of the tunnel is blacker
than black.
"Under apartheid, whites and blacks met in certain places. The Israelis
and the Palestinians do not meet any longer at all. The separation is
total. It seems to me that the Israelis would like the Palestinians to
disappear. There was never anything like that in our case. The whites did
not want the blacks to disappear. I saw the settlers in Silwan [in East
Jerusalem] - people who want to expel other people from their place."
Afterward we walk silently through the alleys of Balata, the largest
refugee camp in the West Bank, a place that was designated 60 years ago to
be a temporary haven for 5,000 refugees and is now inhabited by 26,000. In
the dark alleys, which are about the width of a thin person, an oppressive
silence prevailed. Everyone was immersed in his thoughts, and only the
voice of the muezzin broke the stillness.

When did the colonizers start harassing Onkwehonwe on Cornwall Island?
They always have.
There weren^Òt always colonizers around. Even the Supreme Court of Canada
in 1996 admitted: ^ÓWhen Europeans arrived in North America, aboriginal
peoples were already here, living in communities on the land, and
participating in distinctive cultures, as they had done for centuries.^Ô
There wasn^Òt even a ^ÓCanada^Ô. There were no bridges.
When the British corporations arrived they formed an alliance with the
Haudenosaunee called the Two Row Wampum. That meant no interfering with
the Onkwehonwe rights. The 1794 Jay Treaty between Britain and the United
States said that ^ÓIndians^Ô could cross the border that was set up for
the settlers. Because of the Two Row Wampum they knew that the Onkwehonwe
were not to be affected by this border.
So what made Canada think it could put a border post on Cornwall island in
the middle of Akwesasne and start pestering Onkwehonwe? It^Òs a delusion.
Back then we were probably laughing. What border? The invaders said,
^ÓWe^Òre setting up a border and it^Òs only for us!^Ô
As John Boots and some other old timers remember it, a railway bridge was
put in first. People started crossing it and went right on using it after
the rail track was pulled up. Some folks figure the Canadian border
control on Cornwall Island went in about 1934 when they built a bridge for
cars. The Canadian National Archives in Ottawa should have the records.
1934, this was at the height of the ^ÓDepression^Ô and the height of the
^Óoppression^Ô. A ^Óperson^Ô was still defined as ^Óan individual other
than an Indian^Ô in colonial Canada^Òs Indian Act. Canada^Òs Parliament
took that definition out in 1954, but that didn^Òt change much. The
Canadian government went right on illegally expropriating wherever it
wanted. In the 1950^Òs they kicked Onkwehonwe off our land in both
Akwesasne and Kahnawake to build the St. Lawrence Seaway. The people
fought tooth and nail against it.
With the Seaway came a new bridge and new tolls. What^Òs the difference
between a toll and a tax? Not much. They both make it hard to afford
anything.
What led up to the blockade of the Cornwall Bridge in 1968? An elder
said: ^ÓWe^Òre a pretty self-reliant people. We don^Òt like to complain.
If we get into trouble we try to take care of it ourselves.^Ô But when
they started charging duty on groceries, it was just too much.
Things came to a head when Canadian officials tried to make Mike
Mitchell^Òs mother, Esther, pay taxes on a sack of potatoes. Someone
called a meeting. Nikawen:na^Òa recalls someone from Kahnawake asking,
^ÓHow can you live on the Island where the road passes by and let them
charge taxes on you people? It^Òs your land!^Ô
^ÓThat opened up our eyes^Ô, she said. People went right out and blocked
the bridge. A group of 14 and 15 year old Kahnawake boys who couldn^Òt get
a ride walked all the way to Akwesasne to help. Canada^Òs National Film
Board made a movie about it. It^Òs called You Are on Indian Land.
Forty years later. Same bridge, same problem. John and Harriet, who live
nearby, are always being called over to witness abuse. Aside from the
June 14th assaults on Kahentinetha and Katenies there is a pile of almost
300 border abuse complaints.
So the 1968 blockade of the Cornwall border didn^Òt change much. A few
years ago, it was finally decided that the people of Akwesasne didn^Òt
have to pay the bridge toll. They also tried making an ^ÓIndian lane^Ô
where those with a special sticker could go ahead instead of waiting in
line with the tourists.
Trouble is you can^Òt use the lane if you have a friend or relative with
you who is not from Akwesasne. The restriction interferes with the family
life and the right to free association. Onkwehonwe are still forced to
declare everything in the car:
^ÓWhere did you go? How much did you spend? What store did you visit? Show
me your receipts. Where were you born?^Ô We get asked that even the 300th
time we go past the same blood sucking officer.
Some people get annoyed and refuse to pay the tax. Mike Mitchell tried
that. Look what that got him? The Supreme Court of Canada wouldn^Òt even
recognize his ancestral right to cross the river of the Ongwehonwe.
On top of that, CBSA treats anything different with suspicion. Say you
pull into the regular lane and you notice there^Òs a couple of tourists
and a camper ahead of you. You^Òre late for a doctor^Òs appointment. So
you back out and go to a shorter lane:
^ÓWhy did you back out of that lane? Open your trunk.^Ô
^ÓThere^Òs nothing in it. I^Òm late for an appointment^Ô
^ÓOpen your trunk^Ô.
Since 9/11 things have gotten worse. The guards seem to target Onkwehonwe
women and children especially. This makes their men mad. People at
Akwesasne think the guards are trying to provoke a violent incident as
part of their campaign to carry guns. Meanwhile the Americans are
building a big new facility to block their side of Akwesasne. Their
trying to ^Ócage^Ô us.
They are always in orange alert mode with their ^Ó9/11^Ô delusions about
terrorism.
What gives the colonizers the right to draw and quarter the
Kanion^Òke:haka? We never agreed that the visitors could jump their
colonial ship and start bullying us in our canoe.

Miriam Aviles-Reyes was pulled over by Tucson police while driving
brown, pregnant and without papers in December 2007. In this era
where the border has been extended into city streets, the uterus of
Indigenous women cannot escape militarization. Tucson police quickly
called in the border patrol; Miriam went into labor. Instead of her
husband by her side at the hospital, an immigration office kept watch,
insisting that she hurry up and push. As her baby descended through
the birth canal, she recalled, the officer persisted in his threats to
deport her.
Nez Perce-Chicana scholar Ines Hernandez-Avila has addressed how the
reproducing bodies of Indigenous women are subject to state control
because they threaten many nation states and occupying forces with
their ability to reproduce and sustain distinct peoples. With a 4 to
1 birth rate among young Latinas, Indigenous-rooted women pose various
threats to those who fear the browning of this country. Their bodies
and the acts of their bodies are challenges to notions of homeland.
What threat could Miriam have posed for the immigration official to
violate the most sacred moments of life? It is doubtful she would
have attempted escape with a baby crowning. The officer potentially
risked that child's life from the duress that Miriam experienced.
Indigenous midwives say that when a pregnant woman experiences fright,
or trauma, what is referred to as susto, it causes susto in both
mother and child. Luckily, her son was born without major
complications, but only with time will the family know what birth
trauma was inflicted upon this small one's life. For many Indigenous
peoples, the body is a land base and a sacred site and how we come
into this world is certainly a right to life and intricately linked to
self determination.
Miriam, the mother of three U.S. citizens , originates from an old
Nahua village on the road to Xochicalco, a Mesoamerican university in
900 A.D. To be Mexican, even if her Indigeneity was not recognized,
is still to be treated like an Indian during various attempts at
Indian removal in this country. For many like Miriam, their brown skin
and Indian faces do not allow for their Indianess to be physically
invisible. Instead, official narratives surrounding labels such as
"Mexican" and "immigrant" deny their aboriginal histories and claims
and silence their original relationships to this continent. While in
labor, Miriam did sign papers agreeing to leave this country.
Around the same time, a grandmother in South Texas took on Michael
Chertoff and the Department of Homeland Security in yet another
defense by Apache peoples to protect their land base and traditional
territories. Dr. Eloise Tamez and her daughter Margo are engaged in a
historic struggle for refusing to allow the border wall to traverse
the Tamez private property (part of a 1786 Spanish land grant) and
impede their ancestral Native trails. Professor Tamez has been
described as a Mexican American grandmother, and yet she and her
family assert their Indigeneity as Nde' (Lipan and Jumano Apache) and
Basque descendants. El Calaboz Rancheria in the Lower Rio Grande
Valley, wrote Margo in a report to the United Nations, is located in
traditional homelands which were recognized by other Indigenous
peoples as "the place where the Lipan pray." The government has sued
Tamez and she has countersued, while numerous elders have been
harassed by "armed personnel of the government," according to Margo.
Calaboz, she writes, refers to an earthen dug-out prison: "^Å the
psychological warfare that the Spanish used against our ancestors to
contain them in little prison holes within the ground when they
resisted oppression and stood firm on dissidence against all power to
destroy a people."
The Tamez women are related to Esequiel Hernandez, the student who was
shot by U.S. Marines while herding his goats along the border in
Redford, Texas , in 1997. He was the first civilian killed by U.S.
military or National Guard since Kent State. A recent documentary
portrays how the marines, though charged with murder by the Texas
Rangers, were never prosecuted after a grand jury declined to indict
them. According to the Tucson-based Coalicion de Derechos Humanos, the
four- man unit, part of Joint Task Force Six, was the first known
joint domestic operation between the Departments of Justice and
Defense, and a precursor to the Department of Homeland Security.
Esequiel was Jumano Apache and doing what his ancestors have always
done, walk their traditional lands. As a local historian noted in The
Ballad of Esequiel Hernandez, they have walked those lands for 12,000
years. But Esequiel wasn't "crossing the border." Its militarization
has extended from the womb of one Indigenous mother to another. A
2008 report by that human rights coalition documented 128 bodies
recovered in the Arizona-Sonora border, including a miscarried fetus.
That which was life in a woman's womb, child, tissue, blood, has
become these militarized lands.

I did a blog entry yesterday regarding the Kauai's Water and Wastewater
Electricity Problem indicated in the '2007 Kauai County Energy
Assessment' (conducted July to Nov. 2007) dated March 27, 2008 for the

There was a little bit of useful information in that blog entry that
elicited a much more interesting document 'Water Plan 2020' now stored at

Lies told on the U.S. Senate Floor by
Senators Inouye and Dorgan Regarding the Akaka Bill
Once Again the Ultracrepidarian Critic Raises His Perverted Head. Here we
have a foreign settler that professes to know more about Hawai'i's
history than the people who actually come from Hawai'i. He rewrites our
history and does a ballerina-spin in his tutu woven with his Boston-made
yarn. This presents a battle of wills from perceptions and interpretation
of concepts one has been raised with. His education is limited to what he
reads in books and documents that can support his arguments. His
affilliation with direct descendants of the traitors and conspirators
bolster his arguments with their selective version of events and his
yellow journalistic tactics to deride any opposition to his thwarted
facts are most evident.
With Conklin, we, too, are faced with the concern of his ignorance or
blatant lies. Distorting facts and total fabrication is obvious as well
as withholding facts to enforce his arguments. His endeavor to kill the
Akaka Bill is in accord with many of us but his reasoning and arguments
are on the opposite side of the scale. He's emboldened to spout his myths
brazonly while knowing most U.S. Americans will unknowingly side with his
rhetoric. This self-aggrandizement of being the champion of the patriotic
U.S. American fits his profile as a blind patriot with little substance.
Conklin will do well in stating things in a more correct light without
the snide remarks that incite people to angrily react to his words.
Robert Wuhl stated a very real observation regarding U.S. American
history: "The stories that made up America (are) the stories that America
made up." and "...when the legend becomes fact; print the legend." We can
see this manifested in Conklin's account of what occurred in Hawai'i from
the U.S. conspiracy, invasion, and occupation, annexation, and statehood.
Professional skeptic, Michael Shermer, says, "Humans tend to convince
ourselves to believe: We over-value the 'hits' that support our beliefs,
and discounts the more numerous 'misses'." I am certain that this is what
Ken Conklin is greviously guilty of through exaggeration and distortion.
His mislaid emphasis colors his bias within his arguments he employs to
strengthen his third-hand information. He has made many incorrect
statements and spins a fancy tale in relating the facts.
Conklin believes facts should fit into his imperfect accounts of what
occurred to whitewash his country's guilt and erase the shame and
dishonor it has self-imposed on itself. Paraphrasing other people's words
doesn't help him make his points; thus, we shouldn't rely on Ken
Conklin's account either, as much of what he says are a hodge-podge of
nonsense. It will do better if one does their own research and get to
know how the people of that time felt about what was going on. What is
important is what the people in Hawaii thought of it at that time; since
it involved them directly.
I won't debunk the contrived historical account given by Conklin since it
is riddled by numerous errors and would be too lengthy in this writing to
address. I will say that Slade Gorton and his fellow objectors felt
betrayed by Inouye (whom I don't care for either) and were concerned that
the "...logical consequences would be total independence." Inouye
pronounced to Congress that the Hawaiians were loyal U.S. Americans and
would not seek independence. There was no talk of it used to demand a
race-based government handouts and to support a secessionist movement
during the passage of the Apology Bill. The concern was that the
Hawaiians would seek total independence and the de-occupation of the U.S.
Under the circumstances, it would not be secession; we would be seeking
de-occupation by the U.S. A.
The Akaka Bill is a contrived version of the sovereign nation of Hawai'i
as perceived by U.S. Americans to fit the character akin to the Native
Americans. Mr. Conklin should get his facts straight before posturing his
own errant interpretations. He is printing the myth as fact; the stories
that America made up!

Thte Akaka bill may soon be debated in the U.S. Senate. That's why this is
a good time to remind everyone about some flat-out lies told by Senators
Dan Inouye (D, HI) and Byron Dorgan (D, ND) on the floor of the Senate on
June 7, 2006 during debate on the cloture motion for the Akaka bill. The

Senator Dorgan said: (Congressional Record page S5557): 'I will give a
little bit of the history as vice chairman of the Committee on Indian
Affairs. [He is now Chairman because the Democrats have the majority] ...
January 16, 1893 - that is a long, long time ago^Ó- the United States
Minister John Stevens, who served, then, as Ambassador to the court of
Queen Liliuokalani, directed a marine company onboard the USS Boston to
arrest and detain the queen.
This is the queen that served the indigenous people in Hawaii. She was
arrested. She was placed under arrest for 9 months at the palace.'
Senator Inouye said: (Congressional Record, page S5570): 'I think it is
about time that we reach out and correct the wrong that was committed in
1893. Yes, at that time the representative of the people of the United
States directed a marine company on an American ship to land and take
over the government. They imprisoned our queen. No crime had been
committed.
When the new government took over and turned itself over to the
government of the United States and said, Please take us in, the
President of the United States was President Cleveland at that time. He
sent his envoy to Hawaii to look over the case. When he learned that the
takeover had been illegal, he said this was an un-American act and we
will not take over. The queen is free.'
These Senators are probably honorable gentlemen. They wouldn't knowingly
tell lies on the Senate floor. Would they? The same falsehoods are being
taught to thousands of children in Hawaii's schools, and to college
students. They are 'urban legends' repeated so often that the general
public comes to believe them.
These falsehoods are so widely accepted as fact that two Senators felt
comfortable asserting them on the floor of the U.S. Senate as
justification for a controversial bill. Only God can see into the hearts
of Inouye and Dorgan to know whether they were merely ignorant or were
knowingly telling lies. But either way, their colleagues in the Senate
should not rely on anything they say about Hawaiian history.
Mark Twain said, 'A lie can travel half way around the world while the
truth is putting on its shoes.' The falsehoods of Inouye and Dorgan were
quick to tell; the truth will require more careful explanation.
What really happened in 1893?
The USS Boston had just returned to Honolulu from a training cruise to a
different island. When the ship left on the cruise things had seemed
politically stable; but when the ship arrived back in port the situation
was frightening. The Queen had used bribery and intimidation to ram
through some very controversial bills (distillery, lottery, and opium
licensing bills) in the closing days of the legislature and then
dismissed it.
Immediately thereafter she announced that she would unilaterally proclaim
a new Constitution giving herself near-dictatorial powers. According to
some sources her new Constitution would also take away voting rights from
everyone except ethnic Hawaiians (After the revolution she destroyed all
copies of her proposed Constitution so nobody could find out).
The Queen's personally appointed cabinet refused to endorse her new
Constitution. Some of them ran out of the Palace in fear for their lives
when she threatened them. Ethnic Hawaiians assembled on the Palace
grounds expecting to hear a new Constitution being proclaimed; and
instead the Queen told them to go home because some obstacles had arisen.
There were rumors that there would soon be riots and arson â^À^Ó several
times in recent years there had been riots due to political instability,
which had necessitated the landing of British and American sailors to
restore order on those occasions.
A group of 1500 local men, including several hundred who belonged to an
armed militia, was known to be planning a revolution. Mass meetings had
already been going on for several days after the Queen tried to proclaim
her new Constitution, so there was no secret that a revolution was
underway.
The American diplomat, Minister Stevens, had gone on the USS Boston's
training cruise, taking his family along. When the ship headed back to
Honolulu Stevens' daughter stayed behind on another island to do some
sightseeing. She was killed in an accident there, which Minister Stevens
learned about just before the revolution, possibly affecting his judgment
and concentration.
Now American residents pleaded with him to send sailors ashore as
peacekeepers to protect American lives and property and to prevent
rioting and arson. There were also citizens of other nations who were
residents and business owners in Honolulu.
Some of them, including European diplomats, begged Minister Stevens for
help, pointing out that the USS Boston was the only foreign ship in port
with men who had rifles and military training. The revolutionaries were
mostly Caucasian, so Europeans and Americans living in Honolulu were
fearful that violence might be directed against Caucasians in general.
At Minister Stevens' request the ship's captain sent ashore 162 armed
sailors on January 16, 1893, two days after the mass meetings and one day
before the local militia took over buildings and issued their
proclamation. The sailors were under orders to remain strictly neutral in
the political conflict.
Some royalists imagined the sailors were landed to support the Crown --
that had happened 19 years previously when Kalakaua defeated Emma and
Emma's supporters rioted. Some revolutionists imagined the sailors had
come ashore to assist them.
The sailors marched past the Palace and the Government Building
(Aliiolani Hale) on the way toward a suburban area (Waialae) where they
hoped to spend the night. As they passed the Palace they respectfully
dipped their flags in salute to the Queen.
When it turned out they had no place to spend the night, their officers
made arrangements for them to sleep in a building (Arion Hall) located
down a side street a block away from the Palace, with no direct view of
the Palace or the Government Building. They went there that evening and
remained in the building, or inside its fence.
The following day, January 17, the local militia finally completed its
revolution by taking over the Government Building, where many armaments
had been stored by the Queen's forces. The militia issued a proclamation
abrogating the monarchy and announcing a Provisional Government.
Shortly thereafter the militia took over other buildings and disarmed the
Royal Guard. The militia had zero assistance or supplies from the U.S.
peacekeepers. The local militia arrested the Queen and escorted her to
her private residence a block from the Palace. The Provisional Government
then assigned members of the ex-queen's own (former) Royal Guard to
protect her from harm, and paid the Guards' salaries.
Nobody touched the Queen or her property at her private home. There was
some vandalism at Iolani Palace, and eventually the new government sold
its furnishings. But vandalism is normal when revolutions overthrow a
monarchy.
Also, the Palace and its contents were the property of the nation, not
the personal property of the head of state; so whatever government was in
power had the right to dispose of Palace contents.
One reason for the revolution was to put an end to the lavish lifestyle
of a corrupt monarchy. The Queen was treated with extreme politeness and
gentleness, especially when compared against what happened to the French
and Russian royals when those countries had revolutions.
Throughout the revolution the U.S. peacekeepers remained strictly
neutral. They never took over any buildings. They never surrounded the
Palace or the Government Building. They never arrested the Queen. They
never patrolled the streets. The armed revolutionary local militia easily
maintained order, partly because they were strong and well trained, and
partly because the Queen's forces were weak and had surrendered without a
fight.
She wrote a letter saying she was surrendering temporarily to the
superior forces of the U.S. until such time as the U.S. government would
hear her case and restore her power. But she had that letter delivered to
the revolutionary Provisional Government, not to the U.S. diplomat;
indicating she knew the local Provisional Government was in charge and
not the U.S.
She probably intended her letter of surrender, being addressed only to
the U.S. and claiming it was only a temporary surrender, as a ruse. Being
a clever politician she probably hoped a powerful distant nation whose
incoming President was her personal friend would undo her loss to the
local militia who had actually defeated her.
The U.S. Senate Committee on Foreign Affairs, whose chairman was Senator
John T. Morgan (D, AL), spent January and February of 1894 investigating
the U.S. role in the Hawaiian revolution. They took testimony under oath,
in open session, with cross examination. The committee's official
808-page report, known as the Morgan Report, provides documentation for

Senator Dorgan was entirely wrong when he said 'United States Minister
John Stevens ... directed a marine company onboard the USS Boston to
arrest and detain the queen.' If that claim were true it would be a basis
for blaming the U.S. for overthrowing the Hawaiian monarchy and demanding
reparations. But it was false. The local militia of Hawaiian residents
did all the heavy lifting of the revolution.
Senator Dorgan then continued with another sentence that contains a bit
of truth but placed in the wrong time frame and falsely blaming the U.S.
and Minister Stevens for what happened. Senator Dorgan says: 'She was
arrested. She was placed under arrest for 9 months at the palace.'
The ex-queen was indeed arrested and held at the Palace - but not in
1893, not in connection with the overthrow of the monarchy, and certainly
not by the U.S. peacekeepers. In January 1895 - two years after the
revolution!
Robert Wilcox, a half-Hawaiian racial demagogue, attempted an armed
counter-revolution which failed. Guns and bombs were found buried in the
flower bed of the ex-queen's private home at Washington Place, where she
also had signed commissions appointing cabinet ministers and department
heads for her anticipated new government.
She was convicted of conspiracy in that treason. She did not spend 9
months under arrest in the Palace, as Senator Dorgan said; she spent only
January 16 to September 6, 1895 -- seven and one half months. She had
been sentenced to 5 years at hard labor and a $10,000 fine; but served
only a few months in a huge Palace room with full-time maidservant.
Her 'hard labor' consisted of composing songs and sewing a quilt with
monarchist political slogans and symbols. Later her friend, Republic of
Hawaii President Sanford B. Dole, gave her a full pardon and allowed her
to travel to Washington D.C. where she showed her gratitude by lobbying
the Senate against Dole's most cherished dream of annexation.
Senator Dorgan also made a very misleading statement which ironically
contained the truth about why Liliuokalani was overthrown. Dorgan said
'This is the queen that served the indigenous people in Hawaii.' Yes
indeed!
But her job as Queen was to serve all the people in her multiracial
nation. Saying that she was Queen only of 'the indigenous people' (i.e.,
ethnic Hawaiians) is what must be said to justify passing a racially
exclusionary 'Native Hawaiian Government Reorganization' bill. But the
fact that she saw herself as serving 'the indigenous people' exclusively
or primarily is what caused her to be overthrown by those whom she was
dis-serving.
Senator Inouye told similar falsehoods and also wrongly consolidated the
events of 1893 with the events of 1895. Inouye was totally wrong when he
said '... the representative of the people of the United States directed
a marine company on an American ship to land and take over the
government.' Inouye was totally wrong when he said 'They imprisoned our
queen.' If Inouye is referring to 1895 when Liliuokalani was imprisoned
at the Palace, he was totally wrong when he said 'No crime had been
committed.' - 'Liliuokalani had indeed committed the crime of conspiracy
in a violent counter-revolution in which men were killed. She allowed
guns and bombs to be hidden in the flower bed of her private home, for
which she was placed on trial, convicted, and sentenced to prison.
Inouye was also totally wrong to say the ex-queen's imprisonment was at
the hands of the United States. The U.S. did not imprison her in the
Palace in the 1893 revolution - it was the local militia which arrested
her and escorted her to her private home where her former Royal Guard was
paid by the Provisional Government to protect her against possible
assassination. By 1895, when the ex-queen was indeed imprisoned, the U.S.
peacekeepers were long gone from Hawaii^Ó- Grover Cleveland's hatchet man
(Blount) had removed the few remaining peacekeepers on April 1, 1893.
Those who arrested and jailed her in 1895 were officers of the Republic
of Hawaii.
Following his incorrect statements about the imprisonment of 1895, Inouye
then returns to 1893 to the period of several months after the
revolution, showing that Inouye thinks 1895 and 1893 were all
intermingled and all to be blamed on the U.S. Talking about the
Provisional Government's offer of a treaty of annexation immediately
after the revolution, Inouye says 'When the new government took over and
turned itself over to the government of the United States and said,
Please take us in, the President of the United States was President
Cleveland at that time. He sent his envoy to Hawaii to look over the
case. When he learned that the takeover had been illegal, he said this
was an un-American act and we will not take over. The queen is free.' But
of course by the time President Cleveland issued his message to Congress
it was December 18, 1893, 11 months after the revolution. Grover
Cleveland never proclaimed 'The queen is free' because the Queen had
never been under his authority for him to set her free! She had not even
been imprisoned yet!
It is inexcusable for U.S. Senators to assert such falsehoods in a
high-stakes debate, especially when they have many researchers and staff
members who had been preparing these speeches for a long time. It's
equally inexcusable for schools and colleges to be teaching such
falsehoods in their textbooks and lesson plans when reputable scholars
could easily be contacted for fact-checking.
In 1993 the U.S. Congress passed, and President Clinton signed, the
apology resolution. This was a resolution of sentiment to commemorate the
100th anniversary of the overthrow of the Hawaiian monarchy. The
resolution is filled with historical falsehoods and distortions similar
to the ones uttered by Senators Dorgan and Inouye. It would require a
book to describe and document the errors. The beginnings of such a
discrediting of the apology resolution can be found in Chapter 10 of
Thurston Twigg- Smith's book 'Hawaiian Sovereignty: Do the Facts Matter?'

A very interesting repudiation of the apology resolution is found in an
article in the Wall Street Journal of August 16, 2005, at
http://tinyurl.com/exdg3 Slade Gorton and Hank Brown, two former Senators
who had fought against the apology resolution in 1993, published 'E
Pluribus Unum? Not in Hawaii.' They reminded a nationwide audience about
some of the historical falsehoods and alerted readers to the fact that
the apology resolution is being abused to support the Akaka bill. In 1993
Gorton and Brown had warned their Senate colleagues that the apology
resolution would be used to demand race-based government handouts and to
support a secessionist movement. Senator Inouye had promised his
colleagues, on the floor of the Senate, that the resolution would never
be used in any such way. Now 12 years later Senators Gorton and Brown
were saying 'See, we told you so.'
In his short story 'The Man Upstairs' P.G. Wodehouse wrote: 'It is a good
rule in life never to apologize. The right sort of people do not want
apologies, and the wrong sort take a mean advantage of them.' The way the
apology resolution is being used today makes it abundantly clear that
Wodehouse was right. The resolution should be repealed.

Expenditures reported on agency's Web site raise some concerns

From thousands of T-shirts to the establishment of a bureau office in
Washington, D.C., the Office of Hawaiian Affairs has spent nearly $7.5
million in the past three years on three separate efforts designed to
establish a Hawaiians-only government entity.
OHA spent an additional $2 million in the 2008 budget year that ended
June 30 and has budgeted about $2 million for the current year, OHA
administrator Clyde Namu'o said last week.
The spending is detailed in reports posted recently on OHA's Web site
that represent the fullest public accounting yet on the agency's
nation-building expenditures, an area of controversy for some Native
Hawaiians.
To put things in perspective, the approximately $2 million that is to be
spent on nation-building efforts both this year and next year represents
about 5 percent of OHA's annual operating budget.
OHA has come under fire in some quarters for its aggressive efforts
lobbying for passage of the Akaka bill, enrolling Hawaiians in the Kau
Inoa voter registry, and establishing the Ho'oulu Lahui Aloha Hawaiian
Governance Initiative.

Some feel that OHA, as a state agency, is not the right party to be at
the head of any effort that would lead to negotiating what reparations
are due to Hawaiians as a result of the U.S. role in the 1893 overthrow
of the Hawaiian government.
Activist Mililani Trask said OHA should not take the lead because its
members now are elected by the entire voting public, not just Hawaiians.
"They're trustees to the public, they're not accountable to Hawaiians,"
Trask said.
Namu'o, however, said regardless of how OHA trustees are chosen, OHA's
mandate is clear that "their basic duty is to the beneficiaries first and
foremost."
Trask, a former trustee, said she once supported the Akaka bill but does
not anymore. The bill would create a process that could lead to
establishment of a federally recognized entity that would work with the
federal government. Trask said the bill has been watered down over the
past decade to the point where it would have little positive impact on
Native Hawaiians.
"It's not a question of whether you support federal recognition, it's a
question of whether you support this vehicle," Trask said.
Meanwhile, even some who support the Akaka bill and the other initiatives
question whether money has been spent wisely in pushing the efforts.
OHA Trustee Rowena Akana repeatedly has raised questions about how money
has been spent on the three initiatives, including the unsuccessful
lobbying effort to get the Akaka bill passed.
"I support the Akaka bill, I think we need it because it offers some
protections (for Hawaiians-only programs and services)," Akana said. "But
what I don't support is continuing to pay lobbyists millions of dollars
when they don't produce."
According to records provided by Namu'o's staff, OHA has authorized
paying up to $2.46 million to the Washington-based legal and lobbying
firm of Patton Boggs LLC from May 2003 through this May. Trustees have
approved an additional $450,000 in payments between June 2005 and the
present for "legal services" from Zell and Cox, which is headed by
Patricia Zell, an attorney who formerly was an aide to U.S. Sen. Daniel
K. Inouye, D-Hawai'i. These expenditures are for the strategies that
support OHA's goal of assisting, coordinating and enabling the creation
of a unified Hawaiian nation.
Akana said since the two firms have not been successful in getting the
bill passed, OHA should instead divert its money and other resources
toward other strategies.
"What we need to do is to spend more of that money lobbying the
non-Hawaiians of this state to support our efforts," she said. People who
aren't informed about the Akaka bill are being persuaded by the
legislation's opponents to "think we want to be separatists and want to
secede and that's nonsense."
Broader support among non-Hawaiians here will translate into support
among senators from other states, she said.

Several weeks ago, OHA posted on its Web site a one-page spreadsheet
"strategy expenditure reports" providing some detail on its spending in
the three categories: Kau Inoa, federal recognition and nation building,
for three years from July 2004 through June 2007.
The "nation building reports" were put online "in an effort to reinforce
accountability," the Web site said.
Crystal Kua, OHA's communications director, said the nation-building
expenditures are consistent with one of the agency's goals, that OHA
"shall assist, coordinate and enable the creation of a unified Hawaiian
nation."
The federal recognition category, under which OHA spent about $2.17
million over three years, essentially accounts for money spent lobbying
for the Akaka bill. Among the expenditures listed are approximately $1.4
million for legal advocacy, about $500,000 for general and legislative
advocacy, and $253,000 for mass media education and awareness.
The most money, about $1.12 million, was spent in 2006, the year the
Akaka bill went up for a cloture vote before the U.S. Senate, which is
the closest the measure has gotten to a full vote on the Senate floor.
The Web site reports OHA spent over the three years nearly $3.88 million
on Kau Inoa, OHA's highly publicized drive to register Hawaiians of all
ages in order to establish a list of voters that would be eligible for
any elections associated with an independent Hawaiian government entity.
To date, OHA has gathered 92,134 signatures, Namu'o said. The goal has
been to reach 200,000. While OHA repeatedly has tried to separate the Kau
Inoa registry from the Akaka bill, both come under the agency's
definition of nation building.
The Web site reports about $1.6 million in general education and
mobilization support, $1.47 million in mass media education, and $770,000
for an independent entity to serve as a repository of the registration
data base.
The Web site also reports that about $1.45 million was spent on "nation
building," the OHA-initiated plan that's similar to the Akaka bill in
that it would lead to an independent government entity but does not seek
a go-ahead from Congress as a first step.
Among the expenditures for the initiative known as Ho'oulu Lahui Aloha
(to raise a beloved nation) are about $657,000 that was spent on general
education and mobilization support, and $449,000 on mass media education
and awareness.
Namu'o previously has stated that the Ho'oulu Lahui process, from
registration to the election of officers, would cost from $7 million to
$10 million.

Akana said the three online reports do not provide enough details
regarding specific expenditures including travel, grants given to
organizations in exchange for their support of the initiatives and the
cost of Kau Inoa T-shirts given to those who place their names on the
registry.
According to receipts obtained by The Advertiser, OHA was, for instance,
charged $73,255.44 for 12,800 T-shirts in July 2006. Those reports also
show OHA spent thousands of dollars to set up Kau Inoa booths at
functions and to support nonprofits or events in exchange for promotional
considerations of Kau Inoa.
Akana said she repeatedly has been rebuffed in her attempts to get
specifics and has enlisted the help of the Office of Information
Practices to help her.
Akana said she also questions whether the numbers provided account for
all expenditures that can be attributed to the effort.
OHA officials said that they do with one exception: The numbers do not
include salaries, wages and related expenses paid to OHA employees
involved with the efforts.
The numbers also exclude the cost of the recently introduced "Na Oiwi
Olino" radio program which, OHA spokeswoman Kua said, focuses on all OHA
programs, not just nation-building initiatives.
Included in the totals are the nonpersonnel operating costs of the
Washington, D.C., bureau, which is about $400,000 annually, Kua said.
Also included are legal and lobbying fees paid not just to Patton Boggs
and Zell, but other attorneys who have been involved in the three
initiatives, she said.

Many Hawaiian sites not on list for cultural access, group claims

A Wai'anae Coast group has taken the Army back to court over its use of
Makua Military Reservation, saying the service failed to include numerous
"high priority" sites on a list for Hawaiian cultural access, and failed
to provide opportunities for public input on the list as required.
Col. Matthew Margotta, commander of U.S. Army Garrison Hawai'i, said
yesterday's federal court filing still is being reviewed, but added, "The
Army has fully complied with the requirements of the most recent court
order and identified additional sites for cultural access."
Yesterday's filing by community group Malama Makua is the latest in a
court case that dates to 2000.
The group, which consists primarily of Wai'anae Coast residents and
includes Native Hawaiian practitioners, sued the Army that year. It
claimed the Army's failure to prepare an environmental impact statement
for military training in the 4,190-acre valley violated the National
Environmental Policy Act.
The case was settled in 2001 with the Army agreeing to conduct the study.
According to the latest lawsuit, the settlement required that within one
year the Army had to identify additional high-priority areas within Makua
Military Reservation for unexploded ordnance cleanup for cultural access,
and hold public meetings on the plan.
Following that, the Army was required to make a good-faith effort to
promptly secure funding for unexploded ordnance clearance to provide
access to the cultural sites.
In March, U.S. District Judge Susan Oki Mollway ruled that the Army was
in violation of the agreement, and ordered it to begin submitting
quarterly reports to the court until unexploded ordnance has been cleared
from designated priority locations.
Earthjustice attorney David Henkin, who represents Malama Makua,
yesterday said there were two public meetings held by the Army on
high-priority sites in 2002.
"(But) that was the last time there were any public meetings or public
discussion," Henkin said. "Between 2002 and 2008 there have been huge
changes in Makua in terms of the knowledge of what (Hawaiian cultural)
sites are there."
After a fire in 2003, archaeologists discovered 54 new Hawaiian sites
with hundreds of features, Henkin said.
Henkin also said the Army has cut back on cultural access rather than
expanding it, as the result of a 2005 decision that the ground had to be
cleared of unexploded ordnance down to a depth of 1 foot.

Interactive Web page will show off Hawaii to the world

Edgy Lee's Pacific Network TV, which plans to formally launch this fall,
is a first-of-its-kind interactive Web page intended to showcase Hawaii
to the world.
The challenge for Lee, an award-winning film director and producer, is to
create the Hawaii-themed content, work out any technical glitches, and
find a way to sustain the entire enterprise financially.
Pacific Network TV is television on the Web, with viewers having the
ability to watch what they want, when they want.
Conceived less than two years ago, it will offer nine video channels
(including news, science and the environment, and education) as well as
20 subchannels.
The content will include Hawaii-produced films and shows, old TV
episodes, newspaper articles, radio programs and musical specials.
Examples of original content include a show on mixed martial arts with BJ
Penn and Egan Inouye, a series on hula with experts Jeff Mueller and
Kanoe Cazimero, a health program with Dr. Laurie Steelsmith and former
Honolulu Advertiser reporter Bev Creamer, and an interactive courtroom
show starring retired Judge Boyd Mossman and radio personality Frank B.
Shaner.
Hawaiian language programs
Some programs will be broadcast in Hawaiian, and Kamehameha Schools and
Hawaii Public Radio are collaborating on an as-yet-unidentified project.
And Lee has secured the use of KGMB9 CBS Hawaii's extensive video
library.
She also relies on freelance reporters in cities such as Tokyo, New York
and Los Angeles to submit stories with Hawaiian themes.
"It is the perfect platform for Hawaii, a nexus," Lee said. "And it's all
done in Hawaii with local talent."
Beta testing of the site (pacificnetwork.tv) began three months ago, and
in mid-May 300 people were e-mailed a link to the work in progress. Since
then, the site has had 27,000 visits.
For now, "Coming soon" seems to be the most commonly used phrase on
pacificnetwork.tv.
But up and running are links to Hawaiian artisans and others selling
their goods: books, photo albums, CDs and DVDs. Each page has that
familiar shopping cart logo as seen on sites such as Amazon.com.
There also is an arts and culture calendar section directing viewers to
local museums, galleries, theaters and festivals across the islands. A
travel section connects viewers with island visitors bureaus, eco-tourism
groups and farmers' markets.
Pacific Network has been supported by a small group of investors and
sponsors. Its top underwriter is the Office of Hawaiian Affairs, which
has given Lee close to $500,000 of an allocated $954,000.
"We have been very pleased with what we've see so far," said Mark Glick,
OHA's economic development director. "It is an extremely state-of-the-art
system. It's a minor investment for OHA compared to major broadcast media
that are trying to communicate in similar ways."
"Accurate and complete message"
What is particularly important to OHA, Glick said, is "getting an
accurate and complete message out there on a national level about what is
going on in the Hawaiian community."
The Hawaii Tourism Authority has thus far contributed $70,000 to Pacific
Network TV.
"I know it's been a struggle, and as with any thing new, people are
usually a bit hesitant to try it," said David Uchiyama, HTA's director of
marketing. "But people are slowly beginning to see the power of the
visual content. HTA is trying to comport with that to expose the arts and
culture content that we have beyond Hawaii."
Such "viral" marketing, Uchiyama said, includes social networking blogs
and postings at sites such as YouTube, where people can openly discuss
Hawaii as a destination.
"What Edgy is doing is possibly ahead of its time," said Cliff Miyake,
vice president and general manager of tw telecom (formerly Time Warner
Telecom) and a media partner with Lee. "You are just beginning to see big
telecom networks starting Internet projects like this, but she's at the
forefront."
The move to delivering video, print, voice and other content to hand-set
devices like iPhones is called fourth generation, or 4G -- the next
evolution in wireless communication. Another term, Miyake said, is WiMax,
for Worldwide Interoperability for Microwave Access.
"Pacific Network is well positioned to take advantage of this," Miyake
said. "Edgy's challenge is to continue to be viable until all that
technology is available in the next two to three years."
Lee is well aware of the financial challenge, primarily covering an
annual operating budget of $700,000. Her Makiki office is a comfortable
but "wired" location where a half-dozen or more employees share meals,
sip coffee and hover over computers.
Pacific Network has been helped by the Act 221 tax credit. But it will
need to rely on advertising and a subscribers list. There also is hope of
serving as a cable channel.
"I didn't have any model to follow, because no one else that I know of is
doing something like this," Lee said of her project. "We're really out in
the Wild West, and the learning curve has been huge. But there is no
greater potential for educating the world about Hawaii."

As a Wai'anae Coast resident and legislator, I must respond to The
Advertiser's June 19 editorial, "State justified in canceling
mental-health contracts."
I dispute your conclusion, but concur that "Caught in the middle are
about 400 of Hale Na'au Pono's clients, who face potentially disruptive
and wrenching changes as they switch to other providers."
Mental health consumers â^À^Ô not Hale Na'au Pono or the Department of
Health â^À^Ô should be our main concern.
Media discussion has focused on contractual disputes between a private
agency and a state department. The issue is not who is right or wrong. It
is that consumers must receive the services they need, no matter who
provides them.
Hale Na'au Pono has provided culturally sensitive, nationally recognized
services for more than 20 years â^À^Ô something the health department has
been unable to provide alone. My Wai'anae household's members â^À^Ô my
sister as an educator, my mother as a nurse practitioner, and myself as a
legal services attorney â^À^Ô have been more effective in helping many
clients by collaborating with Hale Na'au Pono.
Your editorial rightly stresses the negative impact on consumers as the
health department switches to other providers. Despite claims that it has
staff and facilities to replace Hale Na'au Pono, the evidence is not
there.
With no clear transition plan, the health department's small, new
facility in Makaha, with skeleton staff and part-time hours, is no
replacement for Hale Na'au Pono's full staff and adequate facilities.
The only sensible solution is to extend existing contracts until a viable
alternative is found.

Are GMOs safe?
"Genetically modified organisms (GMOs) can be defined as organisms in
which the genetic material (DNA) has been altered in a way that does not
occur naturally." - WHO website, www.who.int/
"These techniques are generally known as recombinant DNA technology. With
this technology, DNA molecules from different sources are combined into
one molecule to create a new set of genes. This DNA is then transferred
into an organism and causes the organism to acquire modified or novel
traits." - www.wikipedia.org.
Genetically altered, or genetically modified, organisms, have been around
since 1976, when a company called Genetech was established, exploring the
"commercial potential" of recombinant DNA technology. There has been
active debate about this ever-expanding technology ever since. One of the
concerns is the potential, largely unknown, effects of these
never-before-in-existence altered plant or animal genes.
Others include current laws that allow these new genes to be patented,
becoming the legal property of one person or corporation, which leaves the
way open to potential abuse. Owners of patented genes can fine or
otherwise punish unauthorized use - including, for example, farmers who
may not want GMOs at all, but whose fields have become unintended hosts
for patented seeds because of wind blowing them onto the property. (see

Schmeiser vs. Monsanto).
Another example of controversy surrounding GMOs has to do with what has
been called the "Terminator Gene," the patent for which is owned by "Delta
and Pine Land and the United States Department of Agriculture," according
to Wikipedia. "Delta and Pine Land was bought by Monsanto in August 2006,"
it continues; "S This yet-to-be-commercialized technology would allow the
production of first generation crops that would not generate seeds in the
second generation because the plants yield sterile seeds."
For thousands and thousands of years, farmers have saved seed from one
crop to plant the next year; many times this practice has prevented
starvation. "Terminator Gene" technology could make it impossible for
farmers to grow crops without first buying new seed, every year, from some
large corporation. Percy Schmeiser says, "farmers should always be able to
use their own seed."
Today, chances are good that a large portion of the corn, potatoes and soy
products that you eat are genetically altered. How can you tell? You can't
- not easily, anyway - because they have never been required to be
labeled. If, for example, you happen to have a mild individual allergic
reaction to some invisible combination of genes in your tofu or French
fries or corn-syrup-laced soda, it would be pretty much impossible to
isolate the cause.
And you can't simply avoid all genetically engineered food products if you
want to, because none of them are labeled, making it difficult to know
what to avoid. That decision has already been made for you, whether you
have agreed to it or like it or not. Even if you choose to grow all of
your own organic food as a precaution, growing them from purchased
certified organic seed, it doesn't necessarily mean that they haven't been
genetically engineered, because GMOs do not have to be labeled.
Dr. Lorrin Pang, the State of Hawaii's Department of Health Maui District
Health Officer, offers some information on this subject, from a scientific
point of view. Regarding the question of whether there is a significant
difference between GE products and those that are the product of natural
evolution, how closely they resemble each other, and whether additional
caution and testing is necessary, he says, "The FDA does consider GE foods
equivalent to foods produced by conventional methods such as natural
selection and pollination. While they claim that the method of production
might differ, they say that the end product is supposed to be the same.
"This is a position based on intended changes. There is ample warning that
additional screening for unintended effects is needed, according to the
World Health Organization. This necessary additional screening should
cover both unintended products of the gene mutations, profiling all
proteins, as well as the gene's potential for moving into the cells and
bacteria flora of the host (called horizontal gene transfer).
"The bottom line is that a holistic approach is needed to examine all
potential effects of GE products, whether or not they were intended. This
type of screening would culminate in human trials and post-marketing
surveys, and would require that GMOs be labeled as such. Furthermore,
since each product may differ, independent of the method of production,
there is a need to consider each product individually on a case-by-case
basis.
"In theory, compared to traditional methods of crossing/selection, GE
leads to a greater likelihood of unintended genetic effects on plants."
Transgene is the term for "a gene or genetic material that has been
transferred by any of a number of genetic engineering techniques from one
organism to another," according to Wikipedia. The World Health
Organization addresses the unknown and unintended effects of GE plants by
saying, "Introduction of a transgene into a recipient organism is not a
precisely controlled process, and can result in a variety of outcomes with
regard to integration, expression and stability of the transgene in the
host" "If GE plants are not like their conventional counterparts, how
could changes in those plants impact health outcomes for human beings?
Many unintended changes might not result in any health effects, while some
might be beneficial; some might be hazardous. But as a group, unintended
genetic changes in plants will result in more unintended health effects.
Calling it a 'food' does not preclude these health effects," Dr. Pang
says.
"It is a principle of medicine that product inconsistencies lead to more
health side effects. Also, having more good and bad effects simultaneously
doesn't don't necessarily mean that they 'cancel out'. From a single
product, one effect might be good for lungs and another bad for livers,
for example. Furthermore, if one is in a good state of health, the
'beneficial' effects would add very little, and so one only risks the
hazards. If one is very sick with multiple organ failure, the bad effects
might be minor compared to the potential for benefits. This is similar to
medicines - the prescription really depends on knowledge of the patient as
well as ALL health effects of the medicine," he explains.
In the October 13, 2004 edition of the Bangkok Post, WHO assistant
Director Kerstin Leitner says, "At this point, we have no evidence to say
that it is dangerous to consume food products that contain GMOs, but at
the same time we also don't know its negative side. So, we have to say
that we do not know the adverse health effects of GM food."
That's pretty clear.
"According to the precautionary principle, one should not ingest, inhale
(occupational exposure) or inject (biopharmaceuticals) substances without
knowing their benefits and hazards. The hazards need not be zero. But they
must be known, so that we can weigh them against the alternatives. It is
up to the manufacturers of GE foods to create the studies and databases to
evaluate their human health effects.
"While some may argue that safety evaluations cannot be done, since foods
are complicated and there will be many other confounding dietary factors,
many such epidemiologic investigations are done despite this. We may
implicate the potato salad as the source - without identifying the agent -
of illness during a family picnic. Or we may learn that certain types of
juices affect kidney stone formation, for example.
"If these products as a class do have unintended effects which may in
theory lead to health issues, and if the health effects in humans have
been poorly studied - should we be eating them?" Dr. Pang asks.
"The Food and Drug Administration, or FDA, is responsible for protecting
the public health by assuring the safety, efficacy, and security of human
and veterinary drugs, biological products, medical devices, our nation's
food supply, cosmetics, and products that emit radiation. The FDA is also
responsible for advancing the public health by helping to speed
innovations that make medicines and foods more effective, safer, and more
affordable; and helping the public get the accurate, science-based
information they need to use medicines and foods to improve their health,"
according to their mission statement.
Dr. Pang says, "It is appropriate to end with a return to the FDA; much
has transpired since their opening claim of substantial equivalence. The
FDA has been shown in the past few years to be plagued by two faults.
Conflicts of interest, before a U.S. congressional investigation, and
shoddy science.
"FDA epidemiologist David Graham says, 'I would argue that the FDA as
currently configured, is incapable of protecting America against another
Vioxx. We are virtually defenseless.'
"From an internal scientific review of the FDA (Nov 2007, FDA: Science and
Mission art Risk), the FDA lacks an adequate number of scientists and does
not seem to value science in its vision. A quick fix is unlikely since
these same issues were brought up (and have continued) during a similar
review sixteen years ago.
"How much additional testing is required for these novel GE products? They
might now get more testing than conventional foods, but is that enough?
Until science is restored at the FDA (and conflict of interest is
controlled) I would not trust their opinion, or those who blindly cling to
their authority, on this issue," Dr. Pang states.
This is an issue that affects all of us, and it's worth a much closer

Food Choice During Pregnancy Shapes Lifelong Taste Preferences of Baby

(NaturalNews) Children develop a taste for the foods that their mothers
eat during pregnancy and breastfeeding, highlighting the importance of
pregnant and nursing women's dietary choices, according to a new study
published in the journal Pediatrics.
"It's a beautiful system," lead researcher Julie Mennella said. "Flavors
from the mother's diet are transmitted through amniotic fluid and mother's
milk. So, a baby learns to like a food's taste when the mother eats that
food on a regular basis."
Researchers conducted a number of experiments on the food preferences of
infants. In one, they supplemented the diets of some pregnant and nursing
women with carrot juice, then compared the food preferences of their
children with children whose mothers had not had carrot juice. The
children in the former group had more of a taste for carrots than children
in the latter. The same effect was demonstrated with the children of
nursing women who ate raw peaches.
In another experiment, researchers fed green beans to women whose children
had already begun to eat solid food but were still nursing for part of
their diet. At the beginning of the study, the children rejected the green
beans. Once their nursing mothers had been eating the vegetables for a
while, however, the children began to eat them too.
The study shows how important it is that pregnant and nursing women eat
lots of fruits and vegetables, Mennella said.
"Vegetable and fruit consumption is linked to lower risks of obesity and
certain cancers," she said. "The best predictor of how much fruits and
vegetables children eat is whether they like the tastes of these foods. If
we can get babies to learn to like these tastes, we can get them off to an
early start of healthy eating."
The researchers noted that even children who have not had this head start
will still acquire a taste for vegetables if exposed to them regularly.
Parents simply need to avoid getting discouraged when children reject the
foods or demonstrate distaste the first few times.

One of the nastiest aspects of contemporary American capitalism is its use
of prison slave labour. A large captive population (mostly of
Afro-American arrested for minor crime or drug offences, or incarcerated
for life for trivial offences under "three strikes" laws) are forced to
work for a pittance, with their services contracted out to major
corporations. Prisoners don't have union, employment, or workplace safety
rights, so costs can be kept low. And if they complain about their
treatment, you can beat them in the head with a stick. This return to
nineteenth-century employment conditions allows US companies such as Dell,
KMart and IBM to stay profitable.
Now Labour has introduced this practice in New Zealand. Prisoners at
Rimutaka and Auckland Region Women's Prisons will be assembling
photocopiers for Canon. While they'll be getting real training and
learning real skills (as opposed to previous prison work schemes which
have seen prisoners rented out as fruit pickers), according to a
Corrections spokesperson, they will be paid between 20 and 60 cents an
hour. As with previous prison employment schemes, they will have no labour
rights, no employment contract, no effective means of dispute resolution,
and no enforceable workplace safety standards. And of course, no right to
strike for higher wages.
As for Canon, the press release claims they are paying "market rates" -
but given the flexibility of the market, that can mean almost anything,
and given the risks of the scheme, I think its fair to say that they would
not be doing it unless it was far cheaper than the alternatives. So,
they're profiting from the use of slave labour in New Zealand prisons. If
they were doing it overseas, it would be illegal; the Customs Act
prohibits the importation of goods made with prison labour. But by doing
it here, they sidestep the law. As for Corrections, they get to pocket the
revenue while not being exposed to the same labour and employment
standards that private companies have to pay and while having all of its
overheads funded by the taxpayer. Whichever way you look at it, it's
simply obscene. And the fact that Labour - "the party of the workers" - is
doing it is even more obscene.
I support prison employment or training schemes, but they should be
handled transparently, with prisoners working voluntarily, paid market
rates (possibly escrowed until release) with full labour rights, and not
subject to any sanctions for refusing to participate. Any deductions for
room and board should be made transparently, just as they are in the
work-to-release scheme. But the way Corrections handles these schemes now
is the opposite of this, and allows them to effectively rent out their
prisoners as low-wage forced labour. And that is simply not something that
should be allowed to happen in a civilised society.
Update: some people have asked whether prisoners really aren't allowed to
join unions or take industrial action. That's certainly my understanding
from the explanation Corrections gave me when I first looked at this a few
years ago:
The provision of employment for inmates by the Department
does not constitute a formal employment relationship. Rather
the employment is part of skill acquisition and should be
regarded as a training initiative. Inmates do not have,
therefore, the same access as free workers to wages, rights
and other remedies. They do have protections under
Corrections legislation and regulations. Inmates are not
employees of the Department and are not, therefore, subject
to the Health and Safety in Employment Act 1992. However, the
Department will observe the provisions of the Act for all
inmate employment activities...
No rights, no contract, no protections, and a token "incentive payment" in
the place of a wage - they're slaves. And our government is contracting
them out for the private sector's profit. We should all be ashamed of
ourselves for letting this go on.

energy in action, when we feel the need for direction we can turn to
animals in nature for guidance. Animals can show us different ways to
approach and deal with our challenges.
As we hold a question in mind, we can begin to pay attention to the animal
activity around us. Staring out a window we may notice a bird soaring high
in the sky, showing us how to look at our situation from a greater
distance..
If we don't get an immediate answer, we can remember that the universe has
its own perfect timing that doesn't heed the ticking of the clock.
Instead, we can release our question into the universe's care, and then
trust that an animal messenger will carry inspiration our way.
In the meantime, we align ourselves with the universe's rhythm-opening,
humbling ourselves, and shifting our perceptions so that at the perfect
time we will be ready. Then, even weeks later, the sight of a small bird
hopping from branch to branch may signal for us to use a talent other than
our greatest strength and to take small leaps rather than fly over
details.
A squirrel bounding across an open expanse of grass to stash its latest
prize may remind us to check our favorite hiding places for forgotten
treasure. Even if we don't see actual animals, their representations may
hold messages; whether we see them in a shape in the clouds, a picture, or
a show on television, their symbolic meaning is the same.
Animals are closer to the rhythms and cycles of nature and have fewer
distractions from it than humans do. That is why they are the perfect
messengers when we are in need of advice. Just by being themselves they
remind us of the wisdom of the universe, and that all answers are
available to us when we reconnect with our source and with those who know
how to be nurtured by it.

audiences to documentary films, Ted Leonsis, AOL vice chairman emeritus
and producer of award-winning documentary films, launched SnagFilms in
beta Thursday.
The site aims to bring nonfiction films to a global Web audience, promote
viral distribution through virtual movie theater widgets, and encourage
users to engage with the films^Ò issues and supporter communities.
The free service, which shares its ad revenue among filmmakers, lets
viewers find, view, and ^Ósnag^Ô a film to distribute on the Internet.
^ÓThere has never been a time when so many high-quality socially relevant
documentary films have been made, yet even though tens of thousands of
documentaries are submitted to film festivals every year, only a handful
find theatrical distribution,^Ô said Leonsis, whose documentary Nanking
debuted at the Sundance Film Festival last year. ^ÓThrough SnagFilms,
everyone on the Web can be a theater owner and a film distributor if they
just donate their pixels and enable these incredible documentaries to be

SnagFilms also announced its acquisition of indieWIRE, a 10-year-old
news, information, and social networking site for the international

while also providing content for SnagFilms.com.
While at AOL, Leonsis helped develop True Stories, a site that shows
documentaries to an online audience, and ran with the idea to distribute
documentary films through widgets developed by Clearspring Technologies.
Clearspring^Òs widget promoted Cloverfield last year by distributing the
movie to tens of thousands of Web sites.
Through the modified software on SnagFilms, viewers can nab the film^Òs
widget and place it on their own Web site, blog, or social network page
like Facebook or MySpace. They can also link to one of the participating
nonprofits the movie supports.
AOL will continue to provide technical and ad sales infrastructure for
SnagFilms, and will have the right to use SnagFilms^Ò content through its
channels, including Moviefone.
At launch, more than 250 films are available for immediate streamed
playback and an additional 200 new and older films, already under
contract, will be added by mid-August.

Cyberspace is running hot over at Google's PIMA.nius group over the future
of Pacific Radio Network and its pan-Pacific radio stations, including
NiuFM. The network recently announced restructuring and staff were invited
to reapply for jobs. Several jobs are on the line. And tomorrow is D-Day
for redundancies, according to the coconet wireless. Pacific Islands Media
Association (PIMA) this week posted a statement saying that it accepted
the need for restructuring and called for patience. But chairman Aaron
Taouma says this "process is unfortunate" and his statement shouldn't be
interpreted as PIMA backing for the PRN move. "Let's make this a positive
new beginning for Pacific media and Pacific radio broadcasting," he says.
"Get rid of old shackles and bonds and begin again." PIMA seeks to work in
the interests of all Pasifika media people. And it can be tricky balancing
interests. Some of the PIMA.nius online posters have been calling for some
sort of a public debate. Their argument runs that, as the network is a
community broadcaster and receives considerable public funding, it ought
to consult more with a broader Pasifika media fraternity, at least. The
pro-debate lobby is being led by Will 'Ilolahia and others who have been
frustrated at what they think is stonewalling by both PIMA and PRN. So
Will has set up his own blog to hear from disgruntled NiuFM fans who want
a voice. If you have something to say, then you know where to go. The word
seems to be that PIMA is having a rethink and might organise a wider
"general media forum". A good idea.

Maui algae operation will produce biodiesel for power plant
Pacific Business News (Honolulu) - by Nanea Kalani
A Honolulu-based renewable energy company announced plans Tuesday to build
a microalgae-production plant on Maui with the aim of selling biodiesel to
Maui Electric Co.
HR Biopetroleum, a 3-year-old research and development company focused on
converting algal oil to biodiesel, expects to open the plant in 2011.
The cleaner-burning fuel can be used to run cars, planes and power plants.
The Maui project includes an agreement with Honolulu-based Alexander &
Baldwin Inc. to provide land adjacent to Maui Electric Co.'s waterfront
power plant in Maalaea.
Ed Shonsey, HR Biopetroleum's CEO, told PBN the company expects to receive
around 1,000 acres of land, and that it will likely use about 750 of those
acres for algae production.
Algae can typically produce 10,000 to 15,000 gallons of oil per acre per
year, meaning the facility could produce between 7.5 million and 11.25
million gallons of oil annually.
By comparison, the next best crop, palm, yields 600 gallons per acre per
year, he said.
Financial details were not disclosed, but Shonsey said the company is
confident the facility can be profitable in its first year of operations.
"The challenging items, as it should be, will be obtaining all of the
environmental approvals and approvals from the [state] Public Utilities
Commission, which usually takes two to three years," Shonsey said.
The Maui project also involves partnering with Maui Electric Co. to handle
permitting and building of piping to supply the algae facility with about
10 percent of its carbon dioxide emissions, which algae thrives on.
The Maui plant will be HR Biopetroleum's first commercial facility.
Late last year, HR Biopetroleum agreed to a multimillion-dollar deal with
oil industry giant Royal Dutch Shell to head a two-year demonstration
project that will grow six acres of algae on the Big Island.
That facility is expected to be completed by the end of this year at the
Natural Energy Laboratory of Hawaii Authority in Kona.
"We'll no longer just be doing discovery research, but we'll have the
opportunity to scale up what we're doing at NELHA with the pilot
facility," Shonsey said.

BRIEF HISTORY
By the mid-Nineteenth Century, the Hawaiian Kingdom was a progressive,
literate, flourishing, peaceful, independent, Christian nation, conducting
lively trade and discourse among the nations of the world. Hawaii's
enlightened leaders had instituted a constitutional form of government in
1840 (long before most other nations), and became the first non-Euro/
American member of the Family of Nations. The Hawaiian monarchy entered
into formal relationships with nations in Europe, Asia and the Pacific.
The Hawaiian Kingdom had more than 90 diplomatic legations around the
world.
In January 1893, without provocation or warning, the United States landed
marines in Honolulu to support a coup d'etat of the Hawaiian Kingdom
government by a handful of economically powerful insurrectionists (Agro
business owners Dole et al). To avoid needless bloodshed, Queen
Liliuokalani wisely yielded to the superior power of the United States,
until such time the Kingdom would be restored^× In this way the Queen did
not cede power to the insurrectionists ^× thus placing the responsibility
to rectify the unlawful action, squarely upon the shoulders of the United
States.
After concluding an official investigation, (The Blount Report) U.S.
President Grover Cleveland, in an address to the U.S. Congress, admitted
that the United States' actions in assisting the takeover of the Hawaiian
Kingdom was illegal and constituted "an act of war" against a friendly
nation, a violation of international law. To rectify this action,
Cleveland pledged U.S. assistance to restore the Hawaiian Kingdom. That
pledge has yet to be fulfilled.
Previous to the occupation, the United States had consistently and
unconditionally recognized Hawaii as a sovereign national state. This was
affirmed by several treaties and conventions between both countries.
Though repeatedly breached by the United States, these treaties have not
been abrogated. Thus, they still stand.
THE HAWAIIAN KINGDOM STILL EXISTS
Since the1893 coup, the United States has twice admitted its wrongful
participation in an unlawful takeover of the government of theHawaiian
Kingdom^× first in President Grover Cleveland's 1893 address to the U.S.
Congress, then in the 1993 Apology Law (USPL 103-150) signed by President
Clinton and passed by the U.S. Congress.
In July 2002, Dr. Matthew Craven, Justice of the World Court and Reader of
International Law SOAS, University of London, issued a legal opinion
titled The Continuity of the Hawaiian Kingdom (published in the Hawaiian
Journal of Law & Politics: Summer 2004) confirms that, according to the
standards of international law, the Hawaiian Kingdom is in continuity
^×therefore it still exists!
Dr. Craven's opinion supports the position of the Hawaiian Kingdom's
Attorney General, Thomas Anthony, that Hawaiians have the right to a
functioning democratic government with active diplomatic legations. We
extend an invitation to the American people to share in this peaceful
process of political change.

Next generation Concentrator Photovoltaic (CPV) Technology planned for
NELHA site
KAILUA-KONA, July 17 /PRNewswire/ -- A Hawaiian-style blessing of a solar
array precisely tilted to take full advantage of the sun officially
welcomed SolFocus, a Mountain View, California-based solar technology
company, to Hawaii. SolFocus introduced its new Concentrator
Photovoltaics (CPV) to public officials and guests at the Natural Energy
Laboratory of Hawaii (NELHA) on the Big Island.
The blessing was presided by Kahu Danny Akaka Jr., and SolFocus CEO
Gary D. Conley. During the ceremony, Conley recognized SolFocus partners
in the technology project, NELHA, represented by Will Rolston, and the
Hawaii County Economic Opportunity Council, represented by Max Goldberger,
who was instrumental in bringing SolFocus to the islands.
In the past year, SolFocus has been collaborating with NELHA to test
its CPV systems to assure that the technology is ideally suited to a
tropical island environment. Conley also announced plans to expand the
test site with a second generation CPV array in the near future.
"With this first array, we want to seed the market with solar energy
technology that works," Conley said. "We moved SolFocus from my garage in
2005, and from a two-person operation, we now have 120 employees in six
locations. We didn't wait for government subsidies because we felt it was
imperative we get to work now. We got here through collaboration and
partnerships, like our partnership with NELHA, which provided us with a
fantastic combination of geography, climate and people. It's the diversity
of people that make us strong."
Goldberger thanked Conley for "making CPV technology a reality in
Hawaii."
Elizabeth Corbin, acting Energy administrator of the State Department of
Business, Economic Development, and Tourism, spoke on behalf of Governor
Linda Lingle, talked about the Hawaii Clean Energy Initiative, which aims
for 70 percent renewable energy by 2030, and noted that the state is
installing a number of solar energy projects, including a 12 MW PV system
at Kona Airport.
Deputy Managing Director Barbara Kossow represented Big Island Mayor
Harry Kim at the event.
SolFocus' goal is to make solar electricity more cost competitive with
traditional, fossil-fuel power generation. The company's CPV technology
uses a system of non-imaging optics to magnify the light from the sun 500
times onto small, highly efficient solar cells. SolFocus CPV systems use
1/1000th of the active, expensive solar cell material compared to
traditional photovoltaic panels, thus accelerating the trajectory for
solar energy to reach cost parity with traditional energy sources. CPV
solar panels are made mostly of readily available and cost-effective
materials such as aluminum and glass. These CPV systems deliver zero
emissions energy, have the lowest carbon footprint in manufacturing, and
are over 95-percent recyclable.
SolFocus integrates its CPV panels with an intelligent tracker that
continuously aligns the solar array with direct sun rays throughout the
day as the sun moves across the sky. SolFocus tracking systems are also
being used with traditional PV, as the tracker's high degree of accuracy

Some thoughts after the Community Needs Assessment meeting at McKinley
7/15:
The meeting was troubling in several ways:
1. The community that showed up was asked what they wanted from Oceanic
Time-Warner in relation to PEG, however, there was at least one ulterior
motive for this particular meeting that one of the facilitators had
slipped onto the public agenda/record -- Jay (facilitator and not Jay
April, Akaku) informed the audience that in ^Ósome places^Ô PEG was
managed by a State agency or the cable company and that perhaps Hawai'i
should think about this option. This idea surfaced from the DCCA during
the RFP process. Tuesday night, it surfaced again. I suggest that if you
intend to send in testimony or the survey form, please consider stating
emphatically that a State-run or Oceanic-run public access media station
SHOULD NOT be on the table. Unacceptable.
2. Also, an important source of information on what Oceanic can commit to
in relation to its obligations to Public Access providers as part of its
franchise renewal is the following link:

3. The design of the DCCA survey form is flawed. For example, there is no
way to find out the ^Ñbackground, ^Ñknowledge,^Ò or ^Ñconnection to
Oceanic or Olelo^Ò of the person filling in the form. Who else is getting
these forms?
4. The consultancy firm is NOT doing even the bare minimum in gathering
information on Community Needs.
5. In case you weren^Òt there, many people pointed out that no one from
the DCCA or Oceanic had taken the time and trouble to show up. FYI, Clyde
Sonobe, the Cable Regulator on the DCCA, was present, but he stayed
outside in the lobby the whole time.
6. There is a high probability that this Franchise Renewal process will
serve as an occasion for Oceanic and the DCCA to do an end-run on the
stalled RFP process, that is, an attempt to put Public Access in the hands
of a State agency or Oceanic, or otherwise cripple and make Olelo
ineffective. And if Olelo goes, the other PEG access providers in Hawai'i
won^Òt stand a chance.
Olelo or some non-profit, independent corporation like Olelo must be
maintained in Hawai'i ^Ö everyone benefits, even the ones who are not in
favor of freedom of speech. Please provide the link in Number 2 above to
people who want to fill in the DCCA survey.

I admit to bafflement. I admit to a bit of total confusion mixed with a
certain level of stupefied awe and teeth-rattling frustration as to why
anyone with the mental acuity of more than a housefly would think that
stabbing more holes into Alaska and the eastern seaboard in the search
for a few remaining precious drops of oil is a good idea, would solve
anything at all, is anything more than the equivalent of hurling matches
at the devil.
Perhaps I'm missing something. Perhaps there's some dark, secret genius
behind President Bush's otherwise absolutely imbecilic and dangerous
corporate-whore move to lift the federal ban on offshore drilling, a ban
placed there by his own father, as Dubya actually stood there with a
straight face and tried to imply that this insidious move was meant to
impart something good and helpful for a gas-stunned nation, that he was
"doing all he could" to help with prices at the pump, when you could
actually see the oil dripping from his shivery bones and the giant hand
of Exxon shoved up his weak little spine, making his mouth move.
Oh, I fully understand the corporate arguments, even the political ones.
Asking why the oil companies are eager as rabbits on meth to gouge
further into the planet is a bit like asking a surgeon why she wants to
operate, or a lawyer why he wants to sue, or a snake why he wants to sink
his fangs into a nice juicy rat and swallow it whole and smile for a
week. It is, quite simply, what they do.
And politicos, well, they're of course generally terrified of their own
shadows, merely following what the people scream, and enough misinformed
people scream about high gas prices and demand some sort of relief and,
well, politicos from both sides of the aisle will say just about anything
to mollify and deflect and pretend to care, even if it means lying, even
if it means feigning total ignorance and blaming the oil speculators,
even (or rather, especially) if it means an utter and complete shunning
of the facts at hand. ...

This is a wonderful clip. Matt Simmons is the author of ^ÑTwighlight in
the Desert^Ò, is a leading US investment banker, and a long-term advocate
of the peak oil argument. When he was asked to go on CNBC^Òs ^ÑFast
Money^Ò to discuss the high oil prices, he clearly stunned the presenters
with his forthright analysis of society^Òs current perilous situation.
When asked if $147 a barrel is a ^Ñwake up call^Ò he replied ^Óyes, but
we^Òre not having a wake up call, we^Òre having a witch hunt for who got
us here^Ô, a succinct analysis of the current world situation. What was
especially fascinating to watch was when he was asked for his prognosis of
the near future.
The nub of his argument is that oil is still actually very cheap, and that
the biggest danger the world faces at the moment is those people who argue
that the current high prices are a blip, a bubble, a speculators spike.
When asked for his scenario of the next year or two, he replied that the
US would keep dropping its inventories (of oil) and feeling good about it,
which would be followed by a shortage, which would, in turn, lead to ^Óa
run on the banks so fast your eyes would spin. This is when everyone tops
up their tank. We haven^Òt run out of oil, but we could literally run out
of usable diesel and gasoline and then we would have the Great American
Disaster, because within a week we^Òd have run out of food^Ô.
At this point the looks on the faces of the presenters is priceless. Yet
Simmons isn^Òt finished yet. What can we do now, he is asked. We need to
retreat from our oil addiction, ^Óstart living in villages again,
eliminate long distance communiting by liberating the workforce and paying
by productivity and growing food locally, and starting to embrace an
enormous amount of R&D into things we^Òre not really doing anything about
today, like ocean energy, geothermal, then within 5-7 we could get
ourselves out of a very deep hole, but we have to do it real quick^Ô.
The programme^Òs oil analyst then quickly goes straight off back into
business-as-usual, and the discomfort evident in those in the studio
subsides. In Richard Heinberg^Òs ^ÑPeak Everything^Ò, he cites Elizabeth
Kubler-Ross^Òs five psychological stages people go through when told they
have a terminal illness, denial, anger, bargaining, depression,
acceptance. I am increasingly finding these a useful scale by which to
measure where people are at in the peak oil debate. While Simmons appears
to have moved, in this piece, to acceptance, the presenters are still in
the bargaining phase, as if we can somehow haggle and trade our way out of
this.
When I look around at UK society today, we see the denial about peak oil
in the tabloids arguing that high oil prices are all the governments
fault, and in the conspiracy loons who argue there is still hundreds of
years worth of supplies which some mythical ^Ñthey^Ò are hiding from us,
the anger in the striking hauliers and other fuel protesters, the denial
in government circles who still argue that oil will cost $67 a barrel in
2020, the bargaining in the debates around the 2p duty on fuel, the
depression about it seems to be pretty common in writers on the subject,
and then the acceptance, which I guess is what Transition work is trying
to do, to look at the practicalities of where to go once people accept
what is happening. It is fascinating to see what happens as people move
through these stages, and I see lots of people moving through them quite
quickly these days!
What is so fascinating about this clip, is that it is somehow a microcosm
of what happens when people in denial and in bargaining meet someone from
the acceptance stage. Now all we need is for Simmons (and others) to
really integrate climate change into his thinking, and then that
acceptance would be even more powerful! These exchanges are happening
more and more these days, and what is important, I think, is not to take
any of these 5 stages as being somehow superior to any of the others,
there is no moral high ground here, rather they are all perfectly natural
responses to a bewildering situation, although ultimately, the faster we
can move towards acceptance, the faster we can actually start in earnest
our preparations for life after oil.

the Association of Hawaiian Civic Clubs recognized the significance of La
Ho'iho'i Ea and called for monies to be sought to prepare informational
materials to disseminate among the people of Hawaii to explain the purpose
of the renaming of the holiday from "Hawaiian Flag Day" to La Ho'iho'i Ea
and the significance of the events of that day in 1843. As that occurred
17 years ago, I am not sure what ensued re the informational materials,
and I could not find any information that formalized the name change by
the Hawaii State Legislature. Anyway, here's a short synopsis of the

Technology to Sense Whales in the Water
Recently, after looking at the flashy Fred Olsen Express web page, I
decided to re-read the following recent academic report:

A couple of things I noticed. There is a significant, reported and
documented whale strike in the Canary Islands every few months. They have
noticeable increased since 2002 with 3 strikes, 2003 with 8 strikes, 2004
with 6 strikes, 2005 with 6 strikes, 2006 with 5 strikes, and 2007 with 9
strikes. There are a number of high speed vessels operating there. I
compare that to Hawaii over the past year where I have not heard of a
single documented and reported fatal whale strike yet. Does this mean that
there have not been any or just that they were not known to have happened
or that they just weren't reported? I don't know, but it is an interesting
point to ponder.
The other point mentioned at the end of that academic report is Passive
Acoustic Monitoring (PAM). When I look that up, there are some interesting
articles, and this reminds me of some sort of related funding that
Congress may have approved in the past few months. About the articles,

today face a new threat ^Ö violent encounters with ships and pleasure

to prevent collisions between whales and sea-craft.' Julian Cribb reports.
'The unlucky passenger who died when a high-speed ferry rammed into a
sperm whale in the Canary Islands was the world^Òs first known victim of a
new form of pollution ^Ö ocean noise.
Worldwide, the number of ships and pleasure craft that come into collision
with large sea creatures is climbing inexorably ^Ö and the insurance bill
with it ^Ö as numbers of both vessels and whales multiply and the
sea-lanes become more crowded. The cause of the accident, says marine
biologist and Rolex Awards for Enterprise Laureate Michel André, most
probably lay in damage to the whale^Òs sensitive hearing apparatus caused
by the rising roar of man-made noise throughout the oceans. The whale was
stone deaf ^Ö and simply didn^Òt hear the ferry coming in time to avoid
it.
Burgeoning Sea Traffic Deafening Marine Wildlife
What no-one expected when commercial whaling ended was that whale numbers
would one day rebuild sufficiently to become a hazard to sea craft. But in
places where marine traffic is heavy, vessels fast and whale numbers
expanding, crashes are increasingly common. Where the ship is large the
whale comes off second best, but in the case of cruisers, yachts and
smaller vessels, damage can be mutually serious - even deadly.
We often speak of the ^Ñsilent deep^Ò, but the exact opposite is true.
Sink a few metres into the ocean, and light begins to fade. At 40 metres
you enter endless night, where eyes are of little use and hearing is all.
Here, noise moves five times faster - and much farther - than on land.
High frequency sounds decay rapidly but low frequency noise can travel
right around the planet using a special ^Ñsound channel^Ò in the oceans,
centred about a kilometre down. The oceans are the true realm of sound.
Most sea creatures ^Ö from whales and dolphins to fish, squid and shrimps
^Ö respond to sound, and many produce it. They use it to hunt and to avoid
the hunters, to find mates and food, to guide schools of fish, to
navigate, to send messages and transmit warnings, to establish territories
and warn off competitors, to stun prey and deceive predators, to
^Ñilluminate^Ò their surroundings acoustically, to avoid obstacles and
sense changes in water and conditions.
They click bones and grind teeth. They use drum-tight bladders and special
sonic organs to chirp, grunt, sing and boom. They belch gases and liquids.
They vibrate special organs or their entire bodies. They gather to form
great choirs. Sounds emitted by sea creatures span the range from 0.1
hertz to 300 kilohertz.
Far from the ^Ñsilent deep^Ò, the oceans are a raucous uproar.
Into this age-long tumult, in the blink of an evolutionary eye, has
entered a new thunder: the throb of mighty engines and the thrash of
propellers as 60,000 huge vessels plough the world^Òs sea lanes; the
hammer of diesels and scream of outboards as 4 million fishing boats and
more than 10 million ferries and pleasure craft surge to and fro; the
thump and ping of military and fishing sonars; the deafening crash of
seismic ships seeking oil and gas; the blare of acoustic harassment
devices; the grinding of drills and dredges; the low-frequency growl of
scientific experiments designed to monitor global warming.
Scientists report that background noise in the ocean has increased 15
decibels in the last half-century and 1000-fold since the industrial age
began. This is enough, scientists say, to mask and scramble the normal
sounds of ocean life going about its business. Dr Michel André, for one,
is convinced the human uproar is killing whales ^Ö and now, apparently,
people too. ^ÑOne of the major short-term and worldwide threats for the
sea and marine mammals is constituted by the noise produced by artificial
sources,^Ò he says.
In the Canary Islands between six and ten whale collisions a year were
being reported, mainly by fast ferry services. When a passenger died after
a high-speed ferry rammed a basking sperm whale, André, a marine acoustics
expert at the University of Catalonia, was asked to investigate. He
decided to start by studying the dead whales. The first two he examined
showed severe damage to their inner ears. They were, in short, deaf to
certain sounds.
^ÑThe inner ear lesions we found in sperm whales came from two resident
whales which died after collisions. These lesions affected animals of
different ages,^Ò he says, indicating the damage is due to an external
factor, not to aging.
The injuries also occurred at a place in the ear^Òs sensitive structure
corresponding in frequency with the sounds emitted by shipping. To test
whether the wider whale population was affected, his team ran controlled
exposure experiments on 215 sperm whales in the Canaries in which they
played sounds in the same low-frequency range as the affected regions of

NEW RULES PROPOSED FOR `IOLANI PALACE
Show Your Outrage! - Attend Hearings & Tell Them "'A'OLE!" ("NO!")
Department Of Land & Natural Resources (DLNR) will hold public hearings
on proposed new rules for `Iolani Palace.
The rules are an attempt to banish the Hawaiian Kingdom from the grounds
and prevent anyone from claiming the Palace as an active seat of
government in the future.
If successful, DLNR would be able to assert force of law to ensure
"museum" status for `Iolani Palace.
It is vital for all concerned citizens of Hawai`i to attend one of the
hearings.
Let them know DLNR does not speak for you nor need to "protect" `Iolani
Palace from Hawaiians.
