Does free speech exist in Hawaii? A department of the state of Hawaii is
demanding the retraction of a political cartoon published Jan. 18 on the
Web site http://www.ZeroShibai.com and reprinted Jan. 21 on
http://www.HawaiiReporter.com The demands come in response to images and
text ridiculing the Office of Hawaiian Affairs' Kau Inoa campaign as "Cow
Inoa." Haunani Apoliona, writing in her capacity as "Chairperson, Board of
Trustees, Office of Hawaiian Affairs" (OHA) in a Jan. 24 statement
demands: "The cartoon should be pulled and the secret author publicly
identified."
Apparently Apoliona -- and OHA -- believe the government has the right to
dictate what appears in the local media. The saving grace is her inability
to enforce this demand. But OHA is working day and night to gain that
power by winning enactment of the Akaka Bill.
Apoliona's response to the cartoon indicates she is speaking in her
capacity as OHA Chair, not as a private citizen. In addition to signing
the letter with her government title, and sending it to Hawaii Reporter
from her OHA email address, Apoliona's statements indicating she is
speaking as a representative of her department include:
* "OHA and all those raised in Hawaii don't find it funny at all."
* "The Office of Hawaiian Affairs will continue to fight to better the
conditions of Native Hawaiians."
In addition, a KGMB reporter and videographer seeking comment on the
cartoon controversy Jan. 24 received a response not from Apoliona but from
Crystal Kua, Director of Communications for the Office of Hawaiian
Affairs.
Disturbingly, Kua also indicates that OHA believes it can determine what
is and is not a "legitimate" news organization. KGMB reports:
The co-founder of the online newspaper Hawaii Reporter says the cartoon
was sent in from another Web site, and in keeping with the newspaper's
policy, it published the piece.
"That's been our policy since day 1 when we opened 6 years ago, as long as
it's clear and not libelous. That's our policy. We wanna let people
express their views and get a debate going in the community," said Malia
Zimmerman, co-founder of Hawaii Reporter.
"If she just decides to throw everything out there without any kind
sensitivity then she's not a legitimate news organization," responded Kua.
OHA's attitude should be a sharp warning to Native Hawaiians. Indian
reservations are -- by law -- often places where constitutional rights do
not apply. OHA is already showing just what kind of dictatorial powers it
would like to exercise over Native Hawaiians on a post-Akaka-Bill Hawaiian
Indian reservation.
In a 2001 series aptly titled "Broken Trust: Civil Rights in Indian
Country", a reporter for Minnesota Public Radio observes: "Press freedom
is a constitutional guarantee for most American journalists. But many who
work on Indian reservations do not enjoy the same freedom, because the
First Amendment to the U.S. Constitution does not apply to them. Their
protection comes from the Indian Civil Rights Act of 1968, which
guarantees free speech. But it leaves the enforcement to tribal
governments that own most reservation media outlets."
Apoliona complains: "This cartoon is an openly racial slur, a display of a
'small mind.'" She adds: "This cartoon is merely a racist piece of
propaganda." Speaking to KGMB Crystal Kua complains, "It doesn't even have
anything to do with Kau Inoa. There's no political connection to that
whatsoever. They just think it's funny to go ahead and poke fun at
Hawaiians." Which is it: "poke fun" or a "racial slur"?
There are dozens of local comedians who "poke fun at Hawaiians." Shall
they be subject to OHA censorship? Will they be banned from performing at
resorts located on OHA leases along Hilo's Banyan drive? The OHA Trustees
give every indication they will be just so petty. In 2005 the late OHA
Trustee Linda DeLa Cruz ordered removal of a roadside memorial to a Hilo
hit-and-run victim because it was "not Hawaiian style."
Readers can decide for themselves what they think of the cartoon. One
comment sent to Zero Shibai editors calls the cartoon "insensitive and
more than extremely racial." One Hawaii Reporter reader pledges to protest
racism by refusing service to haole customers at his auto repair business.
Others express support for the cartoon and blame OHA for fostering the
racial hatreds Apoliona purports to decry.
"Political Correctness" is an ideological weapon of censorship used by
OHA. As Malia Zimmerman, editor of Hawaii Reporter, explains to KGMB,
"Everybody is really afraid to speak up and investigate or look into the
Office of Hawaiian Affairs because they're afraid they'll be labeled a
racist."
Racism, real or imagined, is just an excuse for OHA. Apoliona gets right
to the nub of the real issue complaining: "While pretending to be a news
site with selected placements of respectable columns and letters, Hawaii
Reporter leaves a long trail of smears against all things that don't fit
its partner, the Grassroot Institute of Hawaii. One of the key missions of
the Grassroot Institute is to kill the Native Hawaiian Government
Reorganization Act, which seeks to protect programs for Native Hawaiians."
Apparently "one of the key missions" of the state of Hawaii, Office of
Hawaiian Affairs is to suppress any and all Hawaii-based opposition to the
Akaka Bill and any news outlet willing to publish anti-Akaka Bill
opinions. This is a problem inherent in having a government department
given the mission of advocating changes in law. Government is supposed to
defend freedom, not restrict free speech in furtherance of a political
agenda.
Apoliona's attitude is expressed when she would normally be expected to be
on her best behavior -- before assumption of any new "sovereign" powers.
This is a sign that a post-Akaka-Bill "Trustee" government would seek to
impose dictatorial controls over those Hawaiians unfortunate enough to
become its subjects. This may seem far-fetched to some, but they would do
well to take a look at Hawaii's future by informing themselves of the
reality in Indian Country.
OHA's attack on free speech should be alarming to all Hawaii residents,
native Hawaiians most of all.

Looks like OHA is trying schedule a hearing as quickly and as quietly as
possible to minimize opposition to this shitty settlement deal.

The bottom line is they never consulted with us, the beneficiaries that

King Kamehameha IV cloak to return to summer palace

The Daughters of Hawai'i, caretakers of Queen Emma Summer Palace in
Nu'uanu, will next month unveil a full-length 'o'o (yellow) and 'i'iwi
(red) feather cloak of Alexander Liholiho, King Kamehameha IV.
A ceremony is set for 1:30 p.m. Feb. 9 at the palace.
Hawaiian protocol will be used for the occasion under the direction of
renowned kumu hula Kaha'i Topolinski.
The event is open to the public, with light refreshments to follow the
ceremony.
Although the exact origin of the cloak is unknown, it is believed to have
belonged to Peleioholani, the early 18th-century king of O'ahu and
Moloka'i.
The cloak was eventually given to Kamehameha the Great, until it was
passed to King Kamehameha IV and his consort, Queen Emma. The cloak was
willed to the Daughters of Hawai'i in 1959 by Alice G. Hite, a longtime
member of the organization, whose husband had purchased the cloak in 1947
at a London auction.
For the past two years, the cloak has been at the Bishop Museum under the
care of conservationist Valerie Free, who has cleaned and restored the
garment.
After the ceremony at the palace the cloak will remain on display at Queen
Emma Summer Palace.
The Daughters of Hawai'i, a membership-based organization founded in 1903,
have dedicated themselves to perpetuating the memory and spirit of the
Hawaiian culture and language. The Daughters care for and operate both
Queen Emma Summer Palace in Nu'uanu and Hulihe'e Palace in Kailua, Kona.

Now that there are voices on the House Judiciary Committee strongly
advocating for meaningful Cheney impeachment hearings, it is high time to
add George Bush to the crescendo.
Just because Dick Cheney is calling the the shots as the acting president,
that does not absolve George Bush. Indeed it makes him a constitutional
co-conspirator.
Last week the non-profit Center for Public Integrity released an
exhaustive study documenting a compelling pattern of false public
statements, 935 of them, that "were part of an orchestrated campaign that
effectively galvanized public opinion and, in the process, led the nation
to war under decidedly false pretenses." And Bush topped the list with
more lies than any other administration figure.
And just yesterday, after having already once rejected H.R. 1585, the
National Defense Authorization Act for Fiscal Year 2008, with an
unconstitutional pocket veto (because Congress did not submit to ALL his
demands), he then attached a signing statement to the revised bill (H.R.
4986) declaring that he would disregard many other sections of the bill
altogether.
The words "out of control" do not even begin to capture the depth of
contempt that George Bush has for the entire rest of our Constitutional
government and its people.

On January 19, Governor Lingle announced: "Gov. Linda Lingle and the
Office of Hawaiian Affairs (OHA) Board of Trustees announced a historic
settlement that "permanently resolves" the ceded land revenue dispute that
has been ongoing for more than 25 years." (Emphasis added.)
While Gov. Lingle may think that this historic dispute has been resolved
by the principal players ^Ö it really hasn't. The so-called State of
Hawaii and OHA are not the exclusive players.
United States Public Law 103-150, the so-called Apology Bill, gives
historic insight into why this so-called "settlement" cannot be the
resolution the parties think it is ^Ö and states, among other things, the
following quoted clauses:
"Whereas, on July 7, 1898, as a consequence of the Spanish-American War,
President McKinley signed the Newlands Joint Resolution that provided for
the annexation of Hawaii;"
First, a "resolution" is a unilateral domestic instrument of the
sponsoring nation and has the force of law, if at all, ONLY within the
boundaries of that nation. The Hawaiian Kingdom was a "foreign" nation ^Ö
outside the geographical boundaries of the United States ^Ö and Hawai'i
could not and did not become annexed to the United States. The idea is as
absurd as today's Congress attempting to pass a resolution to annex
Switzerland ^Ö or any other independent nation ^Ö to the United States.
"Whereas, through the Newlands Resolution, the self-declared Republic of
Hawaii ceded sovereignty over the Hawaiian Islands to the United States;"
Second, while the Republic of Hawaii attempted to cede sovereignty of the
Hawaiian Islands to the United States, it ceded to the United States only
that to which it had title ^Öwhich was nothing. For those who would argue
that there was something that was ceded - How did the Republic get title
^Ö good or otherwise ^Ö to whatever it attempted to cede to the U.S.?
"Whereas, the Republic of Hawaii also ceded 1,800,000 acres of crown,
government and public lands of the Kingdom of Hawaii, without the consent
of or compensation to the Native Hawaiian people of Hawaii or their
sovereign government;"
Third, there was no compensation paid to the Hawaiian Kingdom or its
subjects, the Hawaiian Kingdom continues to have good title to those
lands.
"Whereas, the Congress, through the Newlands Resolution, ratified the
cession, annexed Hawaii as part of the United States, and vested title to
the lands in Hawaii in the United States;"
Fourth, "annexation" normally takes place by "treaty" and a plebiscite by
the subject peoples. There was no treaty and there was no plebiscite.
Therefore, there was no "annexation." Additionally, the United States
could only vest in itself title to the lands that was legally ceded to it
^Ö and the Republic had no good title for the United States to vest.
Therefore, the attempted annexation and cession of Hawaiian Kingdom lands
by and to the United States failed.
"Whereas, the Newlands Resolution also specified that treaties existing
between Hawaii and foreign nations were to immediately cease and be
replaced by United States treaties with such nations;"
Fifth, since "annexation" did not take place, and the existence of the
Hawaiian Kingdom had not been terminated: How could the United States
unilaterally terminate treaties that it was NOT a party to. It could not
AND it did not. Any attempt to do so was legally ineffective.
"Whereas, the indigenous Hawaiian people never directly relinquished their
claims to their inherent sovereignty as a people or over their national
lands to the United States, either through their monarchy or through a
plebiscite or referendum;"
Sixth, the subject lands continue to be lands of the Hawaiian Kingdom ^Ö
and the Kingdom continues to exist.
If the Kingdom didn't exist ^Ö Then why is the United States trying to
re-organize it through S.310 ^Ö the so-called "Akaka Bill?" If the United
States recognizes the Hawaiian Kingdom enough to want to re-organize it -
Then the United States "recognizes" the Hawaiian Kingdom.
Why is further "recognition" necessary by the so-called "Akaka Bill?"
In the attempted Lingle-OHA Ceded Land Settlement Plan, the State of
Hawaii is attempting to settle a dispute with its agency The Office of
Hawaiian Affairs (OHA) over past rents due from these non-owned so-called
"ceded" lands - by the transfer of some of those same non-owned "ceded"
lands.
As is obvious from the discussion above - title to the so-called "ceded"
lands continues to be held by the Hawaiian Kingdom (at least any Kingdom
claim to those lands as the rightful owner supersedes any mythical claim
that the United States and/or the State of Hawaii may contrive) and any
attempt to convert those lands by the United States/State of Hawaii - as a
bailor (one who holds property for the rightful owner) into OHA lands
cannot take legal effect. In other words, the State of Hawaii, whether or
not it is trustee to those lands) cannot convert Hawaiian Kingdom lands to
itself - through its agency OHA.
As argument 6 above states, these lands continue to be Kingdom lands, but
OHA ^Ö as some may argue ^Ö is a "Hawaiian" recipient of "Hawaiian" lands.
This is another myth.
OHA is an agency of the State of Hawaii but the lands belong to the
Hawaiian Kingdom. As the bailor/trustee of those lands, the State of
Hawaii, in attempting to convert those lands, is committing another
illegality (by international law) , which attempt is subject to the
superior rights of the Hawaiian Kingdom (the rightful owner) and its
subjects.
It is no wonder that the State of Hawaii and OHA are ardent supporters of
S.310 - the so-called "Akaka Bill" ^Ö The Native Hawaiian Government
Reorganization Act of 2007 ^Ö that attempts to convert the "Native
Hawaiian Government" (identified in the first paragraphs of Indian Affairs
Committee Report 108-85 as the "Hawaiian Kingdom") into a United States
"Native Hawaiian Governing Entity." This act would, among other things,
correct all the follies of the Newlands Resolution and "disguise" the real
holder of title of the so-called "ceded" lands (the Hawaiian Kingdom),
making it appear that the attempted cession of those lands by the Republic
of Hawaii to the United States was valid.
Inquiring minds will also notice that the process provided by S.310 allows
"American Hawaiians" to carry out this "theft" by the alleged
"re-organization" of "their" government - not by the United States, the
instigator.
There are two dangerous inaccurate presumptions involved in this process.
First, it allows the United States to appear as an innocent third party ^Ö
that "benevolently" helps to provide a process by which Hawaiians (by
racial description) can complicitly correct its (the United States)
attempted misrepresentations, deceptions and frauds beginning with the
Overthrow and extending to the present. (Remember that United States
Public Law 103-150 is the United States' "Apology" for illegally assisting
the "Overthrow" of the Hawaiian Kingdom.)
Secondly, the United States is providing a process by which racial
Hawaiians who have disavowed the Hawaiian Kingdom can convert that Kingdom
into a United States Governing Entity.
If these disavowing Hawaiians are no longer subjects or "descendants of
subjects" of the Hawaiian Kingdom - How can they legally or ethically make
any amendments to that Kingdom's laws and internal matters that would
essentially terminate its existence, and would result in legitimizing the
stealth of its lands?
This process would be akin to having former British subjects of the United
States attempt to convert the Great Britain to some other entity of their
liking. They can't.
It is additionally interesting that the term "Hawaiian" during the era of
the Hawaiian Kingdom was a "political" definition - as the subjects of the
Kingdom weren't restricted to those of the so-called "Hawaiian" race only.
Unfortunately, the so-called "Akaka Bill" defines "Hawaiian" "racially."
It follows that the Native Hawaiian Governing Entity (that the Bill
provides for) is "racial" and "racist."
Additionally, the so-called "Akaka Bill" ignores the non-Hawaiian (by
race) former subjects of the Hawaiian Kingdom and their descendants.
In essence, the so-called "Akaka Bill" attempts to take from the
"political" Hawaiians of the Hawaiian Kingdom and to give the spoils to
"racist" Hawaiians of the United States, and to the United States itself.
That the so-called "Akaka Bill" is a United States smokescreen to correct
the mistakes of its past is obvious. That the Bill also attempts to
legalize the cession of Hawaiian Kingdom lands through the bogus Republic
of Hawaii to the United States is also obvious.
Therefore, the so-called Lingle-OHA Settlement is just another shibai, and
definitely not a permanent resolution.

The yohimbe tree is found growing in the wild throughout tropical west
Africa from Nigeria to Gabon along the coast. It is a tall evergreen with
large, leathery leaves. The inner bark has been used traditionally to
treat angina and hypertension. It was also smoked and snuffed by natives
for its hallucinogenic effect. 519 In some areas of western Africa
including Ghana, the Ivory Coast and Upper Volta, a decoction is used to
treat fevers and leprosy. It is also chewed to help relieve a cough. 520
The yohimbe bark was first brought to the attention of Europeans by early
traders. While on their adventures in western Africa, they heard about the
yohimbe tree. They became interested in finding and trying the legendary
yohimbe bark. They were able to acquire some of the bark and return with
it to Europe. Future trips brought interest in the yohimbe bark, and it
soon was in demand.
Yohimbe has gained popularity because of its use as an aphrodisiac.
Compounds found in yohimbe are known to be precursors of testosterone. It
is found in some athletic formulas for muscle development and body
building. This may also help with both male and female sexual dysfunction
and impotency. A form of yohimbine, yohimbien hydrochloride, a constituent
of yohimbe has been used in some prescription formulas to treat erectile
dysfunction. Yohimbe dilates blood vessels near the skin, mucous membranes
and sex organs. This may cause fatigue in individuals with low blood
pressure therefore, yohimbe should be avoided by individuals with blood
pressure or heart irregularities.
Yohimbine is the active ingredient found in the yohimbe bark. Both the
crude bark and the purified compound are used as aphrodisiacs. 521 The
yohimbine content is thought to be approximately 6%. Other minor alkaloids
found in yohimbe bark include ajmaline, alloyohimbine, corynanthine,
quebrachine and tetrahydromethylcorynanthein. 522 Compounds found in
yohimbe are known to be a precursor of testosterone.
Studies have found that yohimbine works as a treatment for impotent men.
523 Yohimbe is listed in the Physicians Desk Reference as a sensual
stimulant. It aids to increase the sexual desire, but the main function is
to increase the blood flow to the erectile tissue. 524 It has been found
to be effective in treating both organic (physiological) and psychogenic
(mental) forms of impotence. The aphrodisiac effects associated with
yohimbe are related to this dilation. It increases the blood flow and
enlarges the vessels in the sexual organs as well as increases reflex
excitability in the lower spinal cord. 521 Yohimbe has been found to make
the erections harder and firmer through the increased circulation to the
area. It is also thought to aid in maintaining an erection by causing a
compression and preventing the blood from flowing out of the organ.
Vascular disease is known to be a major factor in many cases of impotence.
Atherosclerosis in the body also effects the penile artery reducing
circulation to that area. Atherosclerosis is a common cause of impotence.
526 A study done using rats in 1984 gave small doses of yohimbine to
sexually active male rats. Though they showed normal sexual activity
before, their sexual arousal increased with the addition of the yohimbine.
527 This has lead to an increase in studies involving yohimbe and
yohimbine. It seems to have a similar effect in human studies. It may also
help to increase the production of norepinephrine in the body, which is
known to decrease with age, and effects the formation of erections. The
adrenaline supply may also increase which can heighten the male sensual
stimulation. 528
An Italian clinical study was conducted in 1994 using yohimbine for cases
of impotence. The individuals involved in the study were suffering from
psychogenic forms of impotence due to stress, tension and fatigue. The
group taking the yohimbe had a 71% success rate while the placebo group
had only a 22% improvement. The placebo group then had the opportunity of
trying the yohimbe tablets and the positive results reached 74% among the
placebo group. The study also found that yohimbe had the ability of
stimulating the male libido. 529
A recent study published in the Journal of Urology, tested yohimbine on a
group of men who suffered from chronic sexual dysfunction. The improvement
rate for men who had suffered impotence for less than two years was 81%.
They all took a moderate dose of yohimbine for one month. These results
are very encouraging as the improvement was seen quickly. There was also
significant improvement for men who had trouble sustaining an erection.
They reported fuller and more lasting erections. 530 The results for all
the studies have been positive. Some medical professionals feel that
yohimbe should be avoided because of the possible side effects associated
with its use. The use of yohimbe should be closely watched and monitored
for side effects. Yohimbine is thought to be toxic if ingested in high
doses.

ago, today. On January 16, 1893, four boatloads of United States Marines
armed with Gatling guns and hundreds of rounds of ammunition came ashore
in Honolulu, capital of the independent Kingdom of Hawaii. As the Royal
Hawaiian band played a concert at the Hawaiian Hotel, 162 troops marched
through the streets of Honolulu, heading for the palace. The Queen of
Hawaii, Lili'uokalani, looked down from her balcony as the troops took up
their positions.
The following day, she surrendered at gunpoint, yielding her throne to the
government of the United States.

REMARKS OF JOHN EDWARDS TODAY IN NEW ORLEANS

Thank you all very much. We're very proud to be back here.
During the spring of 2006, I had the extraordinary experience of bringing
700 college kids here to New Orleans to work. These are kids who gave up
their spring break to come to New Orleans to work, to rehabilitate houses,
because of their commitment as Americans, because they believed in what
was possible, and because they cared about their country.
I began my presidential campaign here to remind the country that we, as
citizens and as a government, have a moral responsibility to each other,
and what we do together matters. We must do better, if we want to live up
to the great promise of this country that we all love so much.
It is appropriate that I come here today. It's time for me to step aside
so that history can blaze its path. We do not know who will take the final
steps to 1600 Pennsylvania Avenue, but what we do know is that our
Democratic Party will make history. We will be strong, we will be unified,
and with our convictions and a little backbone we will take back the White
House in November and we'll create hope and opportunity for this country.
This journey of ours began right here in New Orleans. It was a December
morning in the Lower Ninth Ward when people went to work, not just me, but
lots of others went to work with shovels and hammers to help restore a
house that had been destroyed by the storm.
We joined together in a city that had been abandoned by our government and
had been forgotten, but not by us. We knew that they still mourned the
dead, that they were still stunned by the destruction, and that they
wondered when all those cement steps in all those vacant lots would once
again lead to a door, to a home, and to a dream.
We came here to the Lower Ninth Ward to rebuild. And we're going to
rebuild today and work today, and we will continue to come back. We will
never forget the heartache and we'll always be here to bring them hope, so
that someday, one day, the trumpets will sound in Musicians' Village,
where we are today, play loud across Lake Ponchartrain, so that working
people can come marching in and those steps once again can lead to a
family living out the dream in America.
We sat with poultry workers in Mississippi, janitors in Florida, nurses in
California.
We listened as child after child told us about their worry about whether
we would preserve the planet.
We listened to worker after worker say "the economy is tearing my family
apart."
We walked the streets of Cleveland, where house after house was in
foreclosure.
And we said, "We're better than this. And economic justice in America is
our cause."
And we spent a day, a summer day, in Wise, Virginia, with a man named
James Lowe, who told us the story of having been born with a cleft palate.
He had no health care coverage. His family couldn't afford to fix it. And
finally some good Samaritan came along and paid for his cleft palate to be
fixed, which allowed him to speak for the first time. But they did it when
he was 50 years old. His amazing story, though, gave this campaign voice:
universal health care for every man, woman and child in America. That is
our cause.
And we do this -- we do this for each other in America. We don't turn away
from a neighbor in their time of need. Because every one of us knows that
what -- but for the grace of God, there goes us. The American people have
never stopped doing this, even when their government walked away, and
walked away it has from hardworking people, and, yes, from the poor, those
who live in poverty in this country.
For decades, we stopped focusing on those struggles. They didn't register
in political polls, they didn't get us votes and so we stopped talking
about it. I don't know how it started. I don't know when our party began
to turn away from the cause of working people, from the fathers who were
working three jobs literally just to pay the rent, mothers sending their
kids to bed wrapped up in their clothes and in coats because they couldn't
afford to pay for heat.
We know that our brothers and sisters have been bullied into believing
that they can't organize and can't put a union in the workplace. Well, in
this campaign, we didn't turn our heads. We looked them square in the eye
and we said, "We see you, we hear you, and we are with you. And we will
never forget you." And I have a feeling that if the leaders of our great
Democratic Party continue to hear the voices of working people, a proud
progressive will occupy the White House.
Now, I've spoken to both Senator Clinton and Senator Obama. They have both
pledged to me and more importantly through me to America, that they will
make ending poverty central to their campaign for the presidency.
And more importantly, they have pledged to me that as President of the
United States they will make ending poverty and economic inequality
central to their Presidency. This is the cause of my life and I now have
their commitment to engage in this cause.
And I want to say to everyone here, on the way here today, we passed under
a bridge that carried the interstate where 100 to 200 homeless Americans
sleep every night. And we stopped, we got out, we went in and spoke to
them.
There was a minister there who comes every morning and feeds the homeless
out of her own pocket. She said she has no money left in her bank account,
she struggles to be able to do it, but she knows it's the moral, just and
right thing to do. And I spoke to some of the people who were there and as
I was leaving, one woman said to me, "You won't forget us, will you?
Promise me you won't forget us." Well, I say to her and I say to all of
those who are struggling in this country, we will never forget you. We
will fight for you. We will stand up for you.
But I want to say this -- I want to say this because it's important. With
all of the injustice that we've seen, I can say this, America's hour of
transformation is upon us. It may be hard to believe when we have bullets
flying in Baghdad and it may be hard to believe when it costs $58 to fill
your car up with gas. It may be hard to believe when your school doesn't
have the right books for your kids. It's hard to speak out for change when
you feel like your voice is not being heard.
But I do hear it. We hear it. This Democratic Party hears you. We hear
you, once again. And we will lift you up with our dream of what's
possible.
One America, one America that works for everybody.
One America where struggling towns and factories come back to life because
we finally transformed our economy by ending our dependence on oil.
One America where the men who work the late shift and the women who get up
at dawn to drive a two-hour commute and the young person who closes the
store to save for college. They will be honored for that work.
One America where no child will go to bed hungry because we will finally
end the moral shame of 37 million people living in poverty.
One America where every single man, woman and child in this country has
health care.
One America with one public school system that works for all of our
children.
One America that finally brings this war in Iraq to an end. And brings our
service members home with the hero's welcome that they have earned and
that they deserve.
Today, I am suspending my campaign for the Democratic nomination for the
Presidency.
But I want to say this to everyone: with Elizabeth, with my family, with
my friends, with all of you and all of your support, this son of a
millworker's gonna be just fine. Our job now is to make certain that
America will be fine.
And I want to thank everyone who has worked so hard - all those who have
volunteered, my dedicated campaign staff who have worked absolutely
tirelessly in this campaign.
And I want to say a personal word to those I've seen literally in the last
few days - those I saw in Oklahoma yesterday, in Missouri, last night in
Minnesota - who came to me and said don't forget us. Speak for us. We need
your voice. I want you to know that you almost changed my mind, because I
hear your voice, I feel you, and your cause it our cause. Your country
needs you - every single one of you.
All of you who have been involved in this campaign and this movement for
change and this cause, we need you. It is in our hour of need that your
country needs you. Don't turn away, because we have not just a city of New
Orleans to rebuild. We have an American house to rebuild.
This work goes on. It goes on right here in Musicians' Village. There are
homes to build here, and in neighborhoods all along the Gulf. The work
goes on for the students in crumbling schools just yearning for a chance
to get ahead. It goes on for day care workers, for steel workers risking
their lives in cities all across this country. And the work goes on for
two hundred thousand men and women who wore the uniform of the United
States of America, proud veterans, who go to sleep every night under
bridges, or in shelters, or on grates, just as the people we saw on the
way here today. Their cause is our cause.
Their struggle is our struggle. Their dreams are our dreams.
Do not turn away from these great struggles before us. Do not give up on
the causes that we have fought for. Do not walk away from what's possible,
because it's time for all of us, all of us together, to make the two
Americas one.

US Press Secy Snow declared that resolutions are NOT binding; they are
more like a wishlist. The Ku'e petitions can be considered a plebiscite
that was signed by a vast majority of the Kingdom's subjects. They said
NO to the annexation and demanded the Queen and her government be
restored. No matter which way one slices it; the people spoke and said no
to the USA. One can't get any clearer than that. The US has consistently
and insistently tried to obfuscate the truth and created a myth for
reality. Violating the laws of occupation and doing a cover up of the
entire situation drive the US further down the abyss of deceit and fraud.
They are dancing around the hurdles trying not to get caught. They've
already tripped up a few time so it's a matter of time before it catches
up with them. Sadly, the US Americans will not blame their country of the
deception and fraud but blame the Hawaii Nationals for their predicament.
They laughed and scoffed us in denial and now it is scaring them because
the truth is unfolding. They are realizing there is truth of what we say
and they don't want to lose in the end. The shoe is on the other foot and
they don't like it one bit. Now they know how we feel and they don't like
it. I guess we'll have the last laugh, eh?

actively campaigning, he does remain on the ballots of many states,
including Hawaii. It's important to know that Dennis still can get
delegates for the national convention! As long as we can get 15% or more
of the total votes for Hawaii, Dennis will get at least a couple delegates
for the convention. This is extremely important, so PLEASE CAST YOUR VOTE
FOR DENNIS KUCINICH at the Hawaii caucus on Feb 19th!! If you live in a
different state, then please VOTE FOR DENNIS in your primary or caucus!!
The ONLY "wasted" vote is a vote for someone you really don't want!

Activist urges Indians to keep culture

LAME DEER - American Indian activist Russell Means brought his message of
freedom to the Northern Cheyenne Reservation this week.
Means started his talk Wednesday with a story about visiting Mohawk
country in the northeast United States. A group of blonde-haired,
blue-eyed children ran up to him and started talking in Mohawk, which
Means doesn't speak.
One of the children looked up at the brown-skinned man with his long black
braids and said, "Aren't you Indian?" Means said "yes," and the child
asked him, "Why don't you talk Indian?"
The story makes Means chuckle and is a good anecdote of how Indian people
and their lifestyles have morphed and sometimes faded. The children were
light-skinned but spoke their ancestors' language.
"I've seen where intermarriage has not dampened the DNA of our culture,"
Means said.
Some "brown Indians," Means said, are losing their culture and languages.
They rely on tribal councils rather than clan systems to guide their ways.
Means, co-founder of the American Indian Movement, his wife, Pearl, and a
delegation from the Republic of Lakotah arrived Tuesday evening and joined
a memorial observance Wednesday before giving speeches.
The Republic of Lakotah is an activist group that includes Sioux and other
Indians that claims its territory as land bounded by the Missouri,
Yellowstone and North Platte rivers - the western half of the Dakotas,
southeast Montana and northeast Wyoming and most of Nebraska.
The republic has a provisional government that last year started
withdrawing from treaties. At its core, the group eschews tribal
governments that function within the Indian Reorganization Act and have
ties to the Bureau of Indian Affairs.
Because treaties have not been honored by the U.S. government, the belief
is that the documents are no good and that Indian people have a right to
return to their traditional ways of life and governance, said Tim Lame
Woman, general council chairman of the Northern Cheyenne Tribe and
organizer of Means' visit.
Before Means and other spoke at the Charging Horse Casino bingo hall, Lame
Woman stressed that the tribe did not pay Means for coming to Lame Deer.
As Means travels throughout Indian Country, he said, he sees "varying
degrees of eradication. That scares me."
The counter to that eradication is education, Means said, not the white
man's education of boarding schools or even modern-day Western-style
education, but traditional education, Means said.
"What we've got to do is give our children hope and give our children a
purpose, and that, of course, is freedom," he said.
The Palestinians in Israel are a perfect example of the struggle for
freedom, Means said. The people live in "little reservations" and can't
travel to visit loved ones in nearby villages. They are bombed, but they
don't give up, he said.
"Everything we've experienced, they've experienced in spades," he said.
"How do they maintain? Why don't they give up? Because they maintain the
education of their children, and they grow up proud to be Palestinian."
Means has recently started a total-immersion school in which only Lakotah
will be spoken and traditional methods and lessons will be taught.
"We have to be free," he said. "We have to have our own schools. We have
to have our own way of life."

Hog inventory falls again, to 15,000
Advertiser Staff
The inventory of hogs at Hawai'i farms fell to 15,000 head in 2007, a 6
percent decline from a year earlier.
The marketing hog herd totaled 11,400 head, down 4 percent from 2006,
according to a news release from the U.S. Department of Agriculture.
Breeding hogs totaled 3,600 head, down 12 percent from 2006
The inventory of hogs has been declining for several years and is down 35
percent from 2003, the department reported.
Farmers project 1,600 sows will become pregnant from Dec. 1, 2007 through
May 31, 2008. That is unchanged from the previous six-month period and the
same period a year earlier.
Nationwide, the inventory of hogs was 65.1 million on Dec. 1, up 4 percent
from Dec. 1, 2006.

that forced-trade?) or do we choose to save the planet? hmmm. such a hard
decision for those pudnuts (oops, I mean pundits) in Washington. WTO
isn't even fifty years old, so it doesn't qualify for historic
preservation, or maybe just barely. Perhaps, it could be relegated to the
Smithsonian - as an anachronism of the world as we know it and the cause
of its own and the earth's demise. Milleniums from now when other beings
set down on this planet and start digging around, the evidence of what
folly occurred and why will have been preserved to tell the story. p

Communism for capitalists: WTO limits on global warming policy
There is little doubt that government will play THE leading role in
stopping further global warming -- no other institution in society has the
police power or administrative economies of scale to make it happen,
regardless of the specific combination of mechanisms to be used. All of
the Democratic candidates (see here, here, and here) crib some portion of
their climate change / green jobs proposals from the ambitious Apollo
Alliance project, which sees a primary role for government, even it its
more voluntary aspects. Portions of this agenda are also in a bill
co-sponsored by all current senators of both parties running for
president.
Well, as this stunningly candid report (PDF) from the pro-corporate
National Foreign Trade Council attests in explicit detail, virtually every
component of a response to global warming is WTO-illegal. NFTC recounts
the history of environmental policy at the WTO (and GATT), including the
past successful challenges to our Clean Air Act and corporate average fuel
economy (CAFE) standards. They go on to explore how every global warming
bill in Congress -- elements of which are reflected in the candidates'
plans as well -- violates WTO rules.
Among the possible WTO violations: energy efficiency regulations and
standards, government-administered eco-labeling (even voluntary labeling,
as Andrew Green has argued and which is cited in the NFTC paper), public
procurement of climate-friendly goods and services, and possibly even
emissions trading or auctioning - long seen as one of the most
market-friendly way of addressing global climate change. This is mostly
because of the challenge in finding a way to require domestic
manufacturers to comply with costly reforms while importers importing from
less-regulated countries don't have to comply.
As a response, most proposals -- including in Europe and the
Lieberman-Warner bill in the Senate -- require some sort of provision that
importers also buy into the carbon allowances. How could this provision,
which seems just common sense, unravel the whole governmental response to
global warming? As NFTC argues in its section on Lieberman-Warner:
Among the stated purposes of the International Reserve Allowance Program
is "to promote a strong global effort to reduce greenhouse gas emissions"
through "measures^Å that comply with applicable international agreements."
However, several features of the Program may place it in violation of
fundamental WTO principles. The Program may restrict the import of covered
foreign goods into the United States by raising U.S. importers'
transaction costs and placing quantitative restrictions (a "cap") on the
total amount of covered goods that can be imported into the United States.
This may contradict GATT 1994 Article III because it imposes "internal
regulations affecting the offering for sale, purchase, or distribution" of
imported products that may be "in excess of those applied to like domestic
products." Although the Program relates "to the conservation of
exhaustible natural resources" - clean air - and is done "in conjunction
with restrictions on domestic production or consumption," such a cap on
imports may not pass the Chapeau of GATT 1994 Article XX on General
Exceptions because it may be seen as "arbitrary or unjustifiable
discrimination" or a "disguised restriction on international trade." In
determining this, a WTO Appellate Body might resort to a "necessity test"
and a "proportionality test:" the contribution of the Program to the
success of the U.S. cap-and-trade system would be weighed against the
degree of impact that the Program has on imports of covered goods. If the
Program's incremental contribution to the overall success of emissions
trading in the United States, by U.S. entities, is seen to be
insignificant, then it may not qualify as a "least trade-restrictive
measure" and may not qualify for an Article XX restriction, even as part
of a comprehensive climate change-abatement system.
The International Reserve Allowance Program also specifies "covered goods"
in a WTO-incompatible way. It may violate GATT 1994 Article III by
"capping" imports of goods whose manufacture releases large amounts of
emissions in foreign countries. In WTO language, this suggests
discrimination among products based on non-product related processes and
production methods (PPMs). In general, WTO law prohibits the use of
non-product related PPMs to distinguish among products that are commercial
substitutes83. The Program also defines "covered goods" based on their
"close relation" to domestic goods whose production costs rise due to
emissions trading in the United States Under WTO scrutiny, such a measure
is likely to be in violation of GATT 1994 Article III, Paragraph I,
because it applies internal regulations to imported products "so as to
afford protection to domestic production." [emphasis added]
As scary as the report is, and it's well worth a close read, we think
there are even other WTO reforms that are needed to carve out room for
policy space on global warming, including in the area of services related
to mining and other environmental processes that the Clinton
administration happily committed to WTO GATS coverage. (You can find a
fuller list at our online searchable GATS database.) We'll be talking
about these on the blog and in an upcoming report.
How did our priorities get so utterly confused? As our buddy Victor
Menotti has argued,
At a time when governments urgently need to intervene in markets by
sending clear signals that shift the decisions of energy investors and
consumers, the idea of reducing the rights of government through binding
trade disciplines is, at best, unhelpful, and, at worst, antithetical to
the new directions we need to explore. Even proponents of more trade
liberalization, such as the U.S. Trade Representative and the World Bank,
in their reports on trade and climate admit that the most important factor
for shifting energy investment, production, and technology transfer toward
a new carbonless economy is government action to internalize carbon costs.
While NFTC and the WTO are laying out WTO-compliant ways of addressing
climate change (mainly by reducing the marginal tariffs on environmental
goods, which of course countries can do without the WTO), Victor shows how
any policy that privileges increased trade flows actually takes us FURTHER
from the solution, and that any proposals to increase WTO commitments in
energy services (a giveaway to the likes of Halliburton) might actually
cancel out any benefit from trade in "green goods."
All of these trade pacts make us prove that humanity's responses to its
collective problems continue to facilitate trade flows and that they're
NECESSARY. When do we get to vote on whether we think corporations are
NECESSARY? I guess that would get in the way of communism for
corporations.

Tomorrow, Friday, February 1 at 8:30 am, House Bills 2808 and 2820 are
coming up for a joint hearing before the House Committees on (1) Water,
Land, Ocean Resources & Hawaiian Affairs, and (2) Ag. These bills propose
the same amendments in two separate vehicles and use the ruse of
"important ag lands" to try to gut our State Water Code in favor of big ag
interests. These bills are similar to HB 407, which was defeated last
year. So, you can just recycle any testimony that you submitted on that
bill. There are other bills on tomorrow's hearing agenda that are
questionable, but HB 2808 and 2820 are the worst. A brief summary,
talking points, and info on where to send your testimony is included
below.

BACKGROUND & TALKING POINTS:
Both bills use the "important agricultural lands" concept as an excuse for
the latest attempt to cut the heart out of our Water Code, contrary to the
Hawai`i Supreme Court's rulings in In re Waiähole Ditch Combined Contested
Case Hearing, 94 Haw. 97 (2000) (Waiähole). The ridiculous amendments
proposed by these bills attempt to provide corporate ag interests with an
absolute priority to water -- greater even than public trust uses, such as
environmental protection, traditional and customary Native Hawaiian rights
and practices, and domestic water use.
Consider focusing on the following issues in your testimony: 1) HB 2808 &
2820 ARE UNECESSARY. The law already recognizes the public interest in
maintaining agricultural water uses and provides ample protection of
existing uses, including agriculture. In every single case, including
Waiahole, the Commission has given ag. uses all the water they needed and
more. Even when these interests got that water (e.g., Del Monte) they are
still closing up shop; water is not the issue.
2) HB 2808 & 2820 ARE INAPROPRIATE SPECIAL INTEREST FAVORITISM. Waiahole
made clear that even public trust uses don't enjoy an absolute preference.
Yet these bills give certain ag. uses, which Waiahole made clear aren't
public trust uses, an absolute priority that even public trust uses don't
enjoy.
3) HB 2808 & 2820 ARE SIMPLY BAD WATER POLICY. Carving out an absolute
preference for ag uses is antithetical to the comprehensive planning and
management principles underlying the Code's complex regulatory framework.
It effectively exempts these uses from the Code's permitting scheme. Had
such a provision applied to Waiahole, none of the water would have been
required to be returned to the windward streams.
4) IF IT AINT BROKE DON'T FIX IT. The legislature should let the existing
law run its course and support community efforts - such as those in Na Wai
`Eha, Maui - to restore water to streams for public trust uses, instead of
making things more difficult for those communities. Almost all of the
sugar and pineapple plantations have closed, yet water from our streams
continues to be taken and dumped. Instead of changing the law to allow
these former plantation interests to do whatever they please with public
trust resources (including continuing to use public trust resources for
their private commercial gain, i.e. development), the legislature should
provide the Water Commission with the staff and funding necessary to do
their jobs, e.g, establish instream flow standards.
Water, Land, Ocean Resources and Hawaiian Affairs is the lead committee on
both bills and we should focus our efforts on getting them to kill HB 2808
and HB 2820. Ken Ito from Kane`ohe is the Chair of the Committee and John
Riki Karamatsu is the Vice Chair. Some of the legislators on that
committee should be sympathetic including Mele Carroll, Mina Morita, and
Cynthia Thielen. Scott Saiki and Roland Sagum are newer to this committee,
so if you know any of them please contact them directly. Please:
(1) send in testimony opposing HB 2808 and HB 2820 for tomorrow's hearing
(you can send in the same testimony for both bills)
(2) email copies to your legislators, and (3) call your legislators asking
them to attend the hearing and vote NO tomorrow.
These bills are so bad they must be killed, no amendments can make them
acceptable.

My name is __ and i am testifying in strong opposition to HB 2808 and HB
2820, which seek to amend our State Water Code. These measures are
unnecessary and inappropriate, and must be killed.
In Hawai`i, water is a public trust resource in which all citizens have an
interest. Therefore, our state constitution and Water Code were carefully
crafted to strike a balance between the protection and beneficial use of
our water resources. HB 2808 and HB 2820 seek to upset this delicate
balance by prioritizing water for important ag lands. Such amendments are
unnecessary because the Water Code already provides for the "maximum
beneficial use of the water of the State for purposes such as . . .
irrigation and other agricultural uses." HRS 174C-2(c). In addition, the
Hawai`i Supreme Court -- the body charged with interpreting our state
constitution -- has already determined that although the public has an
interest in offstream uses such as agriculture, agricultural uses are NOT
public trust purposes. Please respect the Public Trust doctrine as
articulated in our State constitution and interpreted by our Supreme Court
and kill HB 2808 and HB 2820.
Our State Water Code is not broken and does not need fixing. Tinkering
with the Code, as requested by HB 2808 and HB 2820, will only create
confusion and lead to more litigation. I urge you to kill these terrible
bills.

Regional programs for "Australian Forces Abroad"
"Australia in the Pacific Islands" is one of a series of briefings
published by the Nautilus Institute at RMIT, for the "Australian Forces
Abroad" series of briefing books.
As well as major overseas deployments in Afghanistan and Iraq, Australia
has deployed military, police and intelligence personnel closer to home -
to Timor Leste and the small island states of the Pacific.
Since the late 1990s, Australia has deployed police, troops or naval
vessels to Solomon Islands, Tonga, Papua New Guinea, Fiji and Nauru, and
extended joint operations with New Zealand and other member states of the
Pacific Islands Forum. The largest deployments include Australian
involvement in the Regional Assistance Mission to Solomon Islands (RAMSI),

NAVY AWARDS PRELIMINARY DESIGN CONTRACTS FOR JHSV
WASHINGTON -- The Navy awarded contracts to Austal USA, Bath Iron Works,
and Bollinger Shipyards Inc., for a firm fixed price of $3 million each
for the preliminary design of Joint High Speed Vessel (JHSV) concepts on
Jan. 31.
"Once delivered, the Joint High Speed Vessel will be a key component of
the U.S. military's expeditionary warfare capability," said Rear Adm.
Charles Goddard, program executive officer for ships. "This high speed
transport will carry soldier or Marines, with their gear, to harbors that
would normally be unusable by conventional maritime assets."
Once preliminary design is complete, the Navy will receive detail designs
and construction proposals from the three teams. The Navy intends to award
a single Phase Two detail design contract with construction options in
late 2008. The first ship, an Army vessel, is expected to be delivered in
2011.
The JHSV program is a joint effort between the Army and the Navy to
acquire high-speed vessels for the two branches of the U.S. military.
JHSV will be used for fast intra-theater transportation of troops,
military vehicles and equipment. Currently the U.S. military leases two
HSVs each capable of achieving speeds of more than 30 knots.
A Memorandum of Agreement (MOA) allows the U.S. Navy to use its surface
ship acquisition expertise in acquiring these vessels for the Army, which
will assume full responsibility post acquisition. The JHSV program
merges the Army Theater Support Vessel (TSV) and the Navy High Speed
Connector (HSC), taking advantage of the inherent commonality between the
two programs.
The current program calls for a total of eight ships, three to be operated
by the Navy and five to be operated by the Army. The Army will own and
operate the Army-funded vessels after procurement. Army responsibilities
for their vessels will include crew training and vessel
maintenance. The Navy will have the same responsibilities for the
Navy-funded vessels.

I understand that Solicitation N00024-07-R-2219, for the Joint High Speed
Vessel design (JHSV) was released on 31 Aug 2007 and closed on 31 Oct
2007. I also understand that offers were received, but no contract has yet
been awarded.
The solicitation is quite lengthy, as it is 254 pages. The criteria for
awarding the contract specifically include many non-price factors, so that
low bid is not the controlling factor. The maximum price for the offer is
$3 million.
As a very interested member of the American public, and a Maui resident,
I would like to know how many offers were received, and from whom, though
I do not expect to be told the price they are bidding. Or can you
direct me to the appropriate documents that would contain this
information?
I am particularly interested in whether an offer has been received from
the Hawaii Superferry group. It was built at the Austal Shipyard in Mobile
Alabama.
Is the Navy in the process of negotiating and evaluating these offers?
When may we expect a decision from the Navy? Is there a deadline for the
decision?
